Hershkovitz Allowed
To Move To Atlanta
Staff Report
48th District Court Judge Gus
Cifelli ruled Monday that Benny
Hershkovitz can live in Atlanta,
Ga. while charges are pending
against him for not repaying
$93,000 to 20 couples from Tem-
ple Israel.
The judge set a tentative date of
Aug. 18 for a preliminary exam-
ination in the case against Her-
shkovitz, owner of B&H Travel in
Southfield who did not repay the
temple members after they can-
celled a spring trip to Israel.
Hershkovitz was scheduled to
appear in Oakland County Cir-
cuit Court on Wednesday. His at-
torneys were going to ask Judge
Hilda Gage to withdraw bench
warrants for the arrest of Her-
shkovitz and his wife, Haya. On
Monday, attorneys told Judge
Cifelli that the warrants resulted
from a misunderstanding caused
by Hershkovitz's former attorney,
who told Hershkovitz he did not
have to appear in court June 4 on
another matter.
In that case, Hershkovitz was
being sued by First Federal Sav-
ings Bank and Trust over a
$300,000 business loan.
Hershkovitz's attorney, Mark
Kriger, told Judge Cifelli that his
client's West Bloomfield home
was now owned by First Federal
as part of that case. He said Judge
Gage had already agreed in a con-
ference telephone call to drop the
warrants.
The lawyers asked the judge to
allow Hershkovitz to continue
bond, but live in Atlanta, because
his Atlanta job is his only source
of income. Hershkovitz is working
for his son's vending company,
and the entire family — Benny,
Haya, the son and two daughters
— are living with his son's in-laws
there. One daughter is a student -
at Yale University, and the other,
a recent graduate of Detroit _
Country Day School, will attend
the University of Michigan in the
fall.
Hershkovitz put up $8,500 cash
against his $85,000 bond and the
in-laws' house is being used as col-
lateral. The Attorneys disclosed
that Hershkovitz has also surren-
dered his passport.
Judge Cifelli took the case after
Judge Edward Sosnick disqual-
ified himself because he knows
several of the witnesses.
