It should also be re- membered.that Jewish courts no longer possessed jurisdiction in criminal cases; that privilege had been assumed by the Romans when they took charge of the government of the Province of Judea. In the intervening centuries, perhaps because of the recurrent persecutions of our people in many different countries, our communal respect for the value of life increased. The cruelty of our enemies, be it in Spain during the time of the Inquisition or in Rus- sia during the massacres perpet- rated by the Cossacks in the 17th Century, did not influence us to become as blood-thirsty as were our attackers. A considerable lit- erature arose asking God to re- member our slain Millions and to perform whatever act of ven- geance He deemed suitable in his town good time. Our essential attitude of non- . resistance has been blamed by many scholars of the Holocaust for the comparatively rare occa- sions when, as a group, we re- sisted, as in the Warsaw Ghetto rebellion of 1943 and defended our lives, slaying many of our ad- versaries. With the rise of the State of Israel, attitudes of resis- tance toward attack and ter- rorism have changed. Yet, there are many peace lovers among us who would hesitate to put to death even an assassin openly expressing the cause of the PLO. We must remember that the only person put to death since the State of Israel came into being 38 years ago was AdolphEichmann, who was charged and convicted of the crime of genocide. In that connection we often quote an- other saying of the rabbis, "He who destroys life, dgstroys the . world; and he who saves one life saves the world." We would not suggest that a person charged and convicted of the heinous crime of deliberate •murder should not pay a severe price. Life imprisonment, with- out hope for parole, is an alterna- tive solution. No one would favor the release of habitual criminals because of plea bargaining so that they would continue to endanger society. If is largely a consideration of spiritual predis- position. How sacred the unique gift of life bestowed by a loving and caring God on each of his creatures should be considered! One point has been made overwhelmingly by students of capital punishment that it does not act as a deterrent to murder or other violent crimes. The same scholars maintain that, because of the extensive appeals process, it is more costly to society to in- sist on the death penalty than to incarcerate the criminal throughout his or her life. Many of us opposed to the reimposition of the death penalty are also dis- turbed by the predominant number of poor minority defen- dants who simply cannot afford the type of concerned and knowl- edgeable counsel to prevent execution.
