THE

Austria Amends
Penal Code
On Neo-Nazis

Vienna (JTA) — The Austrian
Parliament last Monday unani-
mously adopted an amendment
to the penal code that will make
it easier for the authorities to en-
force laws against the dissemin-
ation of neo-Nazi and anti-Semi-
tic propaganda.
Existing laws provide for stiff
penalties, fines for neoN azi ac-
tivities are high and the min-
imum prison sentence is 10
years if convicted. But precise-
ly for those reasons, juries have
been reluctant to bring in a guil-
ty verdict, especially if the ac-
cused are juveniles, as many ar-
rested for distributing Nazi
propaganda are.
Meanwhile, high school
teachers in Vienna and in the
provincial capitals have com-
plained of the recent flood of
racist and anti-Jewish leaflets
spread by far rightwing groups.
Under the amended law, the
police, not the courts, will fine
violators. The police, moreover,
no longer need a court order to
confiscate neo-Nazi material to
present in evidence.

Questioned

New York — The American
Jewish Committee has joined a
number of Christian groups in
seeking permission to appear as
"friends of the courts" (amicus
curiae) in a case brought by
Presbyterian and Lutheran
churches against government in-
trusion on religious worship in its
search for illegal aliens.
Samuel Rabinove, the Ameri-
can Jewish Committee's legal di-
rector, said, "Quite simply, the
practices of the Immigration and
Naturalization Service in the case
at bar reek of the police state. In
fact, they are very much analog-
ous to similar governmental prac-
tices in churches and synagogues
in the Soviet Union. It is for these
reasons that AJCotumittee is join-
ing in this case as amicus." •
Rabinove emphasized that the
so-called "Sanctuary Movement"
was not directly involved, and
that the case was limited to the
narrow issue of the use by the INS
of undercover agents in churches
to tape-record conversations elec-
tronically, to ascertain identities
of worshippers, and to record
automobile license-plate numbers
of people in attendance.
