But the judge dismissed Sharon's charge of libel and he did not collect damages from Time. Under American laW, libel can be established only if there is proof of malice on the part of the media. Time nevertheless apologized for its article. Although vindicated in the American court, Sharon pur- sued his libel case in Israel, demanding damages equivalent to $250,000. The proceedings were expedited when Sharon's attorney, Dov Weissblat and Time's attorney, Shmuel Barzel, agreed that the findings of the New York jury could be admit- ted as evidence in the case. This obviated the need to repeat the entire case from stratch. There is no malice tlause in Israeli libel law. The Justice Department's Of- fice of Special Investigation (OSI) has charged that Blach, 65, of La Habra, Calif.,volun- tarialy joined the Nazi Party in 1939 and in June 1940 became a member of the Waffen SS, Hitler's corp of storm troopers. In addition, the OSI charges that Blach participated in the spring, 1945 evacuation march from Wiener Neudorf to Mauth- ausen, in which mumerous per- sons-died, in an effort to flee advancing forces. At a hearing, Blach's at- torney, Ronald Parker of Fuller- ton, Calif., stated that there were 30 charges made against his client and that of the 30, Blach admits to only three. He admits he is not a U.S. citizen, that he was born in Czecho- slovakia, and that he is pre- sently stateless. ssEs 1%.
