Los Angeles (JTA) — A federal
magistrate ruled last week that
the Yugoslavian Nazi war crimi-
nal, Andrija Artukovic, was men-
tally competent to stand trial.
Judge Volney Brown Jr. heard
testimony from the departmental
head of internal medicine at Long
Beach (Calif.) Naval Hospital,
where Artukovic is being cared
for while under custody.
Dr. David Hill said that Ar-
tukovic was physically capable of
undergoing court proceedings.
His opinion was supported by Dr.
John Stalberg, a court-appointed
psychiatrist who was called upon
to determine Artukovic's mental
competence.
Stalberg told Brown that the
85-year-old former Interior and
Justice Minister in the Nazi pup-
pet state of Croatia was suffering
from depression that could be
alleviated by anti-depressant
medication. Brown decided that
since Artukovic's state of health
had both good and bad days, he
would set aside seven days this
month to continue with the ex-
tradition proceedings.
The magistrate also ordered
Hill to report to Artukovic's at-
torney, Gary Fleischman, on the
Nazi war criminal's mental state
on these specific days. Senior offi-
cials of the Simon Wiesenthal
Center, who had been attending
the proceedings against Ar-
tukovic the past few months, re-
ported that the proceedings were
conducted "with utmost fairness."
Dr. Gerald Margolis, director of
the center, said he hoped that the
extradition request will proceed
smoothly and that "this notorious
Nazi war criminal, who has man-
aged to evade justice for over 30
years and who has lived in the lap
of luxury, will finally be brought
to the bar of justice."

Toronto (JTA) — A survivor of
the Auschwitz-Birkenau death
camp complex gave a detailed,
eye-witness account in a cour-
troom here of the murder by Zyk-
lon B gas of more than 1.7 million
Jews.
Rudolf Urba, a 60 year-old
Czechoslovakian-born professor
of pharmacology at the Univer-
sity of British Columbia, was a
key witness in the recent trial of
Toronto publisher Ernst Zundel
who is charged with the criminal
offense of wilfully publishing
false information which causes or
is likely to cause social or racial
intolerance.
Zundel published and distrib-
uted a pamphlet titled "Did Six
Million Really Die?" which claims
that "no living, authentic eyewit-
ness of these "gassings" (at
Auschwitz-Birkenau) has ever
been produced or validated."
But such a witness was pro-
duced in the person of Urba who
was deported to Auschwitz at the
age of 18 and was held there from
June 30, 1942, until his escape,
with a fellow prisoner, Fred Wetz-
ler, on April 7, 1944.
