the refusal of the Israeli Cabinet to
release the text of the secret annex,
although it is prepared to cooperate
with the U.S. court in trying to come
up with an acceptable formula which
might make available some aspects
of it.
Sharon's New York lawyers, the
firm of Shea and Gould, have prom-
ised to pursue the case despite some
apparent setbacks in pre-trial hear-
ings in New York on June 15 and 17.
But other observers speculate that
Sharon's initial round of rather
tough questioning by Barr may re-
sult in an eventual decision to drop
the suit.

The jury trial before Federal
Judge Abraham Sofaer is scheduled
to begin in New York's Southern Dis-
trict Court on Oct. 1.
Under very strict U.S. libel laws,
Sharon's lawyers will have to prove
that Time's allegations were not only
false, but were also published with
"malice" a very difficult proce-
dure.
During the initial pre-trial hear-
ing, the aggressive strategy of the
Time defense became apparent. Barr
repeatedly sought to make Sharon
feel as uncomfortable as possible by
bringing up all sorts of allegedly sor-
did examples of Sharon's career.
Israeli officials and some Ameri-
can Jewish activists following the
initial twists and turns in the
highly-publicized case have already
expressed fear that a long, drawn-out
trial will not only expose some un-
pleasant aspects of Sharon's person-
ality and career, but might also dam-
age Israel's own image in the process.
"There's no shortage of Israeli of-
ficials who would be pleased to see
Sharon drop the case, although they
would love nothing better than to see
Time squirm," one American Jewish
leader said. He asked not to be iden-
tified.
Sharon, who told the pre-trial
hearing that he had not consulted
with any Israeli governmental offi-
cial before deciding to bring his suit,
clearly seemed to recognize this
danger of harming Israel. Thus, he
appeared to set the stage for a possi-
ble excuse in dropping the case dur-
ing one emotional exchange with
Barr on June 17.
"I came to this court, and it is not
an easy thing; I will say it is a hard
thing," Sharon said. "It is nice and I
will say I learned many things, but
for me to come from thousands of
miles away to a trial in a foreign or
friendly country, very friendly coun-
try, it's a very hard thing, very hard
thing.
"But I felt that I had to fight this
libel. It is not only me that was



libeled. I believe that the State of Is-
rael was libeled.
"But at the same time, your
Honor, when it comes to security is-
sues of national interest, I would like

to state before you, your Honor, that I
will be willing to lose the case and not
to reveal any secrets that endanger
the security of the State of Israel."
Sharon also appeared to get him-
self into potential trouble with the
Israeli government by confirming
during the pre-trial hearing that he
had indeed authorized the Defense
Ministry to make available to his
personal attorneys the contents of
the classified Mossad report on Sha-
ron's condolence call to the Gemayel
family in Beirut on Sept. 1, 1982.
The Israeli Cabinet later ruled
that that report could not be made
public. Sharon said that his initial
decision was made based on many
years of involvement in some of Is-
rael's most important national secu-
rity secrets.
Barr is being assisted by Robert
Rivkin and Israel Leshem, both asso-
ciated with his firma Joshua
Rotenstreich is the magazine's Is-
raeli counsel.
Milton Gould is heading up Sha-
ron's legal team, assisted by Arnold
Foster, the former executive director
of the B'nai B'rith Anti-Defamation
League who is now associated with
Shea and Gould. Also representing
Sharon are : Richard Goldstein and
Adam Gilbert of Shea and Gould. Dov
Weissglass is Sharon's Tel Aviv at-
torney.
In addition to standing by its
story, Time hopes to base its defense
on the premise that Sharon's reputa-
tion could not have been damaged by
its story any more than it earlier had
been damaged by-the Kahan Com-
mission, which recommended that he
resign as Defense Minister because
he shared "indirect responsibility"
for allowing the Phalangists to enter
the Palestinian refugee camps.
