In an 87-page decision, Judge Frank Altimari wrote that "while it is evi- dent that Elmars Sporgis watched 100 or 150 men, women and children being marched to an execu- tion site, the court does not believe that Congress in- tended to exclude from citi- zenship persons who were present when others were persecuted." While Judge Altimari wrote that people should "never forget the abomina- ble atrocities inflicted at the hands of Hitler's Nazis," he said the government's wit- nesses to Sporgis' war crimes were not sufficiently credible and left room for doubt. The government re- lied on two videotaped in- terviews conducted in Riga, Latvia. One witness was a former Latvian policeman and the other witness said Sporgis ordered him to de- liver valuables taken from Jews scheduled to be exe- cuted.
