The Jewish News that the
school last year applied
for and received an
exemption from paying
unemployment compen-
sation. He said that the
school applied as a
member of a national
religious organization,
based on its affiliation
with Torah Umesorah —
The National Association
of Hebrew Day Schools.
Cohen said the teachers
were notified last year of the
exemption.
Susan Marwil, president
of the striking teachers,
said the school's actions
during the strike were de-
signed to destroy the union.
Cohen claimed that the
two sides were very close to
agreement Thursday when
they reached impasse. He
said the tragedy of the
teachers' action to stop pic-
keting now instead of weeks
ago was that the school no
longer has positions to be
filled. "If they had made this
decision earlier we would
not have hired so many (re-
placement) teachers and
positions would be avail-
able," Cohen said.
He added that under
the law, any current
openings at Akiva must
be offered first to the
teachers who participate
in the strike. He said the
school now has only one
six-hour, part-time posi-
tion to be filled.
Cohen said the school is
negotiating with one of the
strikers to buy out his con-
tract, another has officially
resigned and a third re-
turned to teach at Akiva
last week.
The teachers have now
asked Akiva to accept a
fact-finder in the negotia-
tions, and to make the fact-
finder's decision binding on
all parties.

Meanwhile,
Fishman of the Michigan
AFL-CIO, Tom Turner of
the Detroit AFL-CIO, and
Hugh Jarvis of the Michi-
gan Federation of Teachers
sent a mailgram two weeks
ago to Judge Avern Cohn,
who just completed his term
as president of the Jewish
Welfare Federation.
The three labor leaders
asked to meet with Cohen
to discuss the Akiva
strike, and stated:

"Akiva receives substan-
tial funds from the Jewish
Welfare Federation. We ask
that the Federation with-
hold granting any contribu-
tions while the strike con-
tinues and the school is op-
erated by scabs.
"If the Federation con-
tinues to supply funds to
Akiva it may be necessary
for the AFL-CIO to request
its members to withhold
contributions to the Federa-
tion on the basis that some
of these contributions are
being used to fund strikeb-
reaking activities by
Akiva."
The Federation allocation
for Akiva for the 1983-1984
school year is $90,500.
Judge Cohn told The
Jewish News that he spoke
to Sam Fishman last week
about the mailgram. He in-
formed Fishman that he is
no longer president of Fed-
eration, but as a matter of
courtesy he would meet
with the labor leaders about

the Akiva stike. "Mr.
Fishman said he would get
back to me," Judge Cohn
said.
