Grose Book Reveals FDR's

reference to David Niles,
who had an important role
in the White House, first in

Christian and Jewish Groups
Challenge RI Nativity Scene

By BEN GALLOB

(Copyright 1983, JTA, Inc.)

Three Jewish organiza-
tions and one Christian
agency, in two friend-of-
the-court briefs, have urged
the U.S. Supreme Court to
sustain two lower court rul-
ings that the annual display
of a nativity scene by the
city of Pawtucket, RI. is un-
constitutional.
One brief was filed by the
American Jewish Commit-
tee and the National Coun-
cil of Churches. The other
was filed by the Anti-
Defamation League of Bnai
Brith and the American
Jewish Congress.
Both briefs asserted that
the sponsorship by Pawtuc-
ket of a Christian display of
nearly life-size figures and a
manger depicting the birth
of Jesus violated the First
Amendment prohibition
against establishment of
religion.
The ADL said the Paw-
tucket case marked the
first time the Supreme
Court has agreed to hear
arguments involving the
constitutionality of a

publicly-sponSored reli-
gious holiday display.
The Jewish Telegraphic
Agency was told that the
Supreme Court may hand
down a ruling in the, case
before the end of November.
Noting that the nativity
scene had been erected in a
private park near Pawtuc-
ket City Hall, the ADL and
the AJCongress stressed
they were not objecting to
the public display itself but
only to the constitutionality
of sponsorship by the city,
which' paid for, owned and
maintained the nativity
scene. The brief contended
that the issues are govern-
ment support for religion
and a governmental* prefer-
ence for one religion —
Christianity — among
many.
The brief of the AJCom-
mittee and the National
Council said that the nativ-
ity scene was "a fundamen-
tally religious symbol" and
that "municipal ownership
and sponsorship of such a
central religious doctrine"
violated the church-state
separation requirement.

Study Refutes
`Brain Drain'
Predictions

JERUSALEM - (i`NI) —
More than 94 percent of the
men and women who re-
.ceived Hebrew University
PhDs between 1976 arid
1982 currently reside in Is-
rael, according to a study by
the university's Unit for
Academic Planning and
Development.
The figure represents a
slight increase in the
number of those holding
doctorates who decided to
remain in Israel rather than
settle elsewhere when com-
pared to Hebrew University
PhDs from the 1950-1975
period. University officials
had been worried that a sig-
nificant "brain drain" was
taking place in Israel.
