Bill to Permit Religious
Activity in Schools Blasted
WASHINGTON (JTA) —
A Senate committee has
been warned by a Jewish
civil rights agency that a
proposed Senate bill to per-
mit religious activity — in-
cluding prayer — in the na-
tion's public schools is "a
threat to our religious free-
doms."
The warning was made in
testimony before the Senate
Committee on the Judiciary
by Ruti Teitel, assistant di-
rector of the legal affairs
department of the Anti-
Defamation League of Bnai
Brith.
Ms. Teitel asserted that
the proposed legislation
Senate Bill No. 1059 --- is
unconstitutional because it
advances religion and
would "excessively
entangle government in
religion."
She declared also that,

with "equal access" to
public school facilities
for religious activities,
the bill incorrectly
equates religious prac-
tices with such secular
extracurricular activities
as "stamp collecting or
hockey."
Ms. Teitel told the Sena-
tors that it was in recogni-
tion of the "special nature of
religion" that the Founding
Fathers adopted the estab-
lishment and free exercise
clauses of the First
Amendment to build a wall
between church and state.
She stressed that the bill
fails each part of the Sup-
reme court's three-part es-
tablishment clause test for
constitutionality.
She said that, first, even
the bill's proponents would
concede "its primary pur-
pose is religious," an objec-
tive ruled unconstitutional
by the Supreme Court in
1948.
Second, she testified,
the effect of the proposed
law would be to "imper-
missibly advance reli-
gion" in the public school
setting where the Sup-
reme Court, recognizing
the vulnerability of
school children, has pro-
vided "heightened pro-
tection" to maintain reli-
gious neutrality.
Finally, Ms. Teitel said,
when prayers and other
religious events occur in
public schools, "the state is
entangled through the use
of the compulsory public
school machinery," because
students are present as cap-
tive audiences due to state
law which obligates them to
be in school.
The American Jewish
Committee joined the ADL
in its opposition to the bill.
In a related development,
the American Jewish Con-
gress, acting on behalf of it-
self and five other Jewish
organizations, called un-
constitutional a New Jersey
state law requiring a "mo-
ment of silence" in all public
schools.
In a related action, the
AJCommittee, National
Council of Churches,
ADL and American
Jewish Congress have
jointly urged the U.S.
Supreme Court to bar the
city of Pawtucket, R.I.,
from using a Christmas
nativity scene in a city-
sponsored holiday dis-
play.
The groups maintained
that the display violates the
Constitutional - principle of
separation of church and
state.
In Detroit, the American
Civil Liberties Union is
suing the suburbs of Bir-
mingham and Oak Park to
prevent the taxpayer-
funded display of religious
symbols on public property
during Christmas and
Hanuka.
The ACLU charged that
the displays violate the
Constitution's First
Amendment guarantees
against government in-
volvement in religion.
