THE DETROIT JEWISH NEWS Precedent Setting Ruling on 'Get' Still Unsettled Weinberger, Sharon, Arens Get Along' TEL AVIV (JTA) — United States Secretary of Defense Caspar Weinberger says he has got along well with both former Defense Minister Ariel Sharon and the new Defense Minister, Moshe Arens. In an interview with Is- rael Radio's Washington correspondent, Weinberger was most diplomatic but hinted there would be no change in American policy as a result of the changes at the Israel Defense Ministry. Denying reports that there had been friction be- tween him and Sharon, the Defense Secretary said he had got on well with Sha- ron, been well received at his Negev ranch and had given a warm welcome to Sharon in Washington. Asked if the U.S. would now sign a memorandum on strategic cooperation JERUSALEM — The He- with Israel, long and brew University of strenuously sought by Jerusalem and the Univer- Sharon, Weinberger said, sity of Paris VIII have "I think the main effort signed an agreement for now ought to be on trying cooperation in the area of to get the President's language traditions and the peace initiative adopted. languages of the Oriental And the first step of that and Sephardi Jewish com- is to get Lebanon on its feet as a strong sovereign munities. nation with all foreign forces removed." Weinberger also said he thought U.S.•aid to Israel would be better served in NEW YORK (JTA) — A precedent-setting ruling by New York State's highest court, that a pre-nupital agreement between a civilly-divorced Jewish couple to submit differences over their religious obliga- tions to a rabbinical tri- bunal is enforceable in civil courts, may have to go back to a lower state court to be implemented, a Jewish legal rights agency official said. Howard Zuckerman, president of the National Jewish Commission on Law and Public Affairs (COLPA), which filed a friend of the court brief in the case, said the wife, as plaintiff, will probably have to apply to a lower state court for an order compel- ling her husband to grant her a Jewish divorce, a "get." The Court of Appeals, the state's highest court, ruled 4-3 in Albany last week that the pre-nuptial agreement in the Jewish wedding cer- tificate, the ketuba, of Susan Avitzur and her former husband, Boaz, is enforceable in civil court. Mrs. Avitzur filed the suit initially in the Sup- reme Court of Albany County following the couple's civil divorce in May 1978. Zuckerman said that the 4-3 Court of Appeals ruling was the first on that issue by the highest court of any of the 50 states. Dennis Rapps, COLPA executive director, said that if Boaz Avitzur accepts the high court's order to appear before a Beth Din (Rabbini- cal Court) with his civilly- divorced wife, which Rapps said was unlikely, the order of implementation would be met. However, he added, a number of issues stemming from the high court's ruling remain to be resolved. Academic Pact invitations in blume 20% OFF 6080 W. On Monday, Arens called Weinberger from Jerusalem to deny press re- ports claiming that Arens had told the Cabinet Sun- day that Weinberger was ••• • • • • • • • • • • • • • • • • • • • • • • • hostile to Israel. The press reports claimed Arens attributed Wein- berger's anti-Israel atti- tudes to his previous busi- ness ties with Arab coun- tries while Weinberger was associated with Bechtel Corp. Weinberger told the NBC "Today" program that he would be surprised if the statement had been made by Arens, based on their past relationship. The press reports also claimed that Arens told the Cabinet that U.S. Secretary of State George Shultz, also formerly associated with Bechtel, had now come to see that the Middle East situation is not as cut and dried as some Administra- tion circles may have thought.
