The conference, a land- mark gathering of its kind, was held under the auspices of the Board of Deputies of British Jews. The delegates represented Jewish com- munities in. The CJC leader said he told the British Prime Minister that her decision to send a task force to deter aggression against the Falkland Islapds exemplified British law. He also noted that the British public saw the conse- quences of terrorism on their television sets every night. It would be unthink- able, he said, that terrorists should have any voice in the forthcoming negotiations between the United King- dom and the Irish Republic. Therefore, Rose said, he told Thatcher he found it in- explicable that the British government should ask Is- rael to negotiate with the Palestine Liberation Organization. Rose said Thatcher re- plied affirmatively when he observed that "it is not possible for Israel to live under the threat of terrorist attacks and we hope that this will be reflected in the policies of Her Majesty's Government." He said Thatcher, whose seat in the House of Commons represents the largest Jewish consti- tuency in London, under- scored the need to con- tinue pressures on the Soviet government to alleviate the plight of Soviet Jews. Francis Pym, the British, Foreign Secretary, ad- dressed the Commonwealth Jewish leaders. He reiter- ated Britain's support for Israel but asserted that the Palestinians must be recog- nized and made part of the peace process, Rose re- ported. Nathan Z. Dershowitz, director of AJCongress' commission on law and so- cial action, says the ruling is in keeping with the statutory guarantees of freedom of religion. An amicus brief filed by the, organization in 1981 urged the appeals court to rule for the employee. • 7 In its decision, the Sixth Circuit Court of Appeals af- firmed an earlier ruling by the U.S.. District Court for. the Western District of Michigan upholding the constitutionality of Title VII of the Civil Rights Act of 1964 which requires em- ployers and unions to ac- commodate the religious practices of employees if they can do so without "un- due hardship." In the case, employee Doris McDaniel claimed religious discrimination because she had been fired from her job at the Essex International Corp. for refusing to join or contribute to the In- ternational Association of Machinists, as re- quired under the union's contract with the em- ployer. Ms. McDaniel said she could not support the union because the tenets of her church, the Seventh Day Adventist, forbid it. She of- fered to make a contribution to charity in the amount of the required union dues, but the union turned down the offer. Ms. McDaniel was fired in 1972. The Sixth Circuit Court of Appeals held not only that where a union contract con- flicts with statutory guarantees of freedom of Friday, December 31, 1982 13 CHARLES FEDERMAN religion, the contract must give way, but that in this case there was no finding that the employer or union would suffer "undue hard- ship." The court also held that an employer could not cite a' union's insistence on enforcement of contract provisions as justification for infringing on an em- ployee's religious rights.
