NEW YORK — New
York state cannot deny a
religious institution tax
exemption simply because
its theological beliefs ex-
tend to political and eco-
nomic issues, according to a
brief filed in the -state's

Court of Appeals by the
American Jewish Congress.
The friend-of-the-court
brief has been filed in a case
involving the Unification
Church of the Reverend Sun
Myung Moon.

is limited to only one of the
grounds on which that find-
ing is based, which, if left
standing, could jeopardize
the legitimate activities of
all religious groups, includ-
ing our own.
"Specifically, the court's
determination that a theol-
ogy whose beliefs extend to
political and economic is-
sues is not entitled to tax
exemption poses a direct
threat to all religions, in-
cluding Jewish institutions
in their support for Israel.
"The notion that religion
must be limited to prayer
and ritual and cannot em-
brace the advocacy of social
and political concerns dis-
torts the historical char-
acter and integrity of both
Judaism and Christianity."

the city of New York had
determined that the Unifi-
cation Church was not
entitled to exemption from
real estate taxes. On appeal,
the Appelate Division held
that the church's involve-
ment in politics disqualified
it from tax exemption as a
religious institution.
In announcing the AJ-
Congress action, Henry
Siegman, executive director
of the organization, issued
the following statement:
"It is not the intention
of the American Jewish
Congress to come to the
defense of the Unification
Church, a group whose
doctrines and practices
we find abhorrent. Fur-
thermore, their proper-
ties in New York City and
elsewhere may in fact not
qualify for tax exemp-
tion, and we do not chal-
lenge the determination
of the Appellate Division
that the commercial use
of its property does not
meet the constitutional
and statutory tests for a
religious institution's
entitlement to tax exemp-
tion.
"The AJCongress action
