California Brief
Against U.S. INS
0-
NEW YORK — The
American Jewish Commit-
tee, together with the Mexi-
can American Legal De-
fense and Educational
Fund, has filed a friend-of-
the-court brief in a Califor-
nia suit that accuses the
U.S. Immigration and
Naturalization Service
(INS) of violating the equal
protection guarantees of the
U.S. Constitution.
The brief charges that the
INS, in an attempt to un-
cover illegal aliens, has
conducted factory raids dur-
ing which its agents have
singled out individuals for
questioning solely on the
basis of racial and ethnic
stereotypes. The brief cites
depositions by a number of
INS agents who candidly
admitted that their deci-
sions to detain and question
persons during a raid were
based solely on such factors
as dark complexion,
Spanish accent, Mexican
garb, nervousness, and
avoidance of eye contact.

gas chambers.
The Institute for Histori-
cal Review has published
neo-Nazi works claiming
hat the Holocaust never
ook place. It promised in
1979 to pay anyone $50,000
if they could prove that gas
chambers were used to kill
Jews.
Mel Mermelstein, a
Holocaust survivor who is
now a Long Beach busi-
nessman, and Simon Wie-
senthal, the Nazi-hunter
based in Vienna, both sub-
mitted evidence to claim the
$50,000.
Barring an out-of-court
settlement, a Los Angeles
County Superior Court will
decide if Mermelstein com-
plied with the challenge to
win the $50,000.
