Testimony Is Obligation
Rather Than Privilege

Where the testimony is
technical, such as establish-
ing the fact of a crime hav-
ing been committed so as to
subject the criminal to capi-
tal punishment, the tes-
timony of women is
excluded. Such is the case,
for example, with the tes-
timony of a king, which is
also excluded.
There are various reasons
offered for this exclusion.
First, giving testimony in
Jewish law is not just a
privilege. It is an obligation.
Thus, in the case of a
woman or a king, such a
person is excused from
the obligation of offering
testimony. In order to in-
sure their being excused
from giving such tes-
timony, their testimony is
simply excluded from all
such cases.

nesses are subjected to in
such cases could be embar-
rassing to the woman or the
king. Thus the exclusion
from such people being wit-
nesses is to protect and
preserve their status of
honor.

types of testimony are made
in public, obligating a
woman to offer such tes-
timony might challenge her
role of privacy, especially
since Jewish tradition was
generally opposed to put-
ting women on public dis-
play.

Superstition

Some people refrain from
starting a new venture or
moving into a new home on
Mondays because in the
series of events involved' in
the creation of the world,
Monday (the second day of
creation — the second day of
the week) was the'day when
a separation took place.
The waters above the fir-
mament. This was a symbol
of disunity. A new venture
or a new home had as its
goal the unity of purpose or
the unity of the family.
It is also claimed by the
mystics that it was on Mon-
day, the second day of the
week that the Gehenna
(Hell) was created. This
day, thus turned out be a
symbol, or indication, or
woe or misfortune or
punishment. When one
started out a new venture or
moved into a new home the
aim was to establish unity
or to get a fresh start in life
which would be free of prev-
ious regretful situations.
Hence such moves are
avoided on Mondays.

Those we call the ancients
were really new in every-
thing.
