NY Drops Death Definitions

NEW YORK (JTA) — Re-
jection by the health com-
mittee of the New York
State Assembly of two bills
defining death as the cessa-
tion of brainwaves has been
hailed by Agudath Israel of
America.
Efforts to legislate a legal
definition of the time of
death have been fought by
Agudath Israel's Legisla-
tion and Civic Action Com-
mission on grounds that "is-
sues which are so deeply in-
erwoven with religious and
----._ ethical implications cannot
be dictated by government."
The bills related to a
patient on a respirator. One
would have permitted a doc-
tor to pronounce such a
patient dead if he had, in the
doctor's opinion, suffered "a
total and irreversible cessa-
tion of total brain function."

The other bill would es-
tablish basically the
same determination of
death but would limit it to
a patient who had willed
his body to medical re-
search, _a procedure
known as an "anatomical
gift."
Such a determination is
unacceptable to Orthodox
Jews for whom ordinary "b-
rain death" is not the final
consideration according to
Halakha which forbids
"pulling the_plug" on the re-
spirator, according to Dr.
Bernard Fryshman, chair-
man of Agudath Israel's
Commission on Legislation
and Civic Action.
The Orthodox agency
charged that if the bills
were passed in their present
form, even minus an
"exemption clause" giving
next of kin the right to ob-
ject on religious grounds, it
would be a "flagrant viola-
tion" of American religious
freedom.

Boat People

LONDON (JTA) — Brit-
ain's Jewish community
will play its part in welcom-
ing and helping to absorb
the 10,000 Vietnamese ref-
ugees whom the govern-
ment has said that it will
allow into this country,
Chief Rabbi Immanuel
Jakobovits said at a press
conference.

Centralizing the commu-
nity's efforts will be the
Board of Deputies of British
Jews. Board President Gre-
ville Janner, said that the
community wanted to iden-
tify tiself publicly with the
plight of the Vietnamese
refugees, "whose suffering
is reflected in our own his-
tory."

for the motion picture,

right here, off Tortola.

Interestingly, even vis-
itor accommodations in the
BVI are often designed
around water. Prospect Reef
Resort, where we stayed on
Tortola, is a perfect example

I'm describing the British
Virgin Islands, a string of
some 40 islands and tiny
cays located 60 miles east of
Puerto Rico. Indeed, the
BVI, as they are affection-
ately known, are one of the
few genuinely unspoiled
areas remaining in the
Caribbean.
As Elihu Rhymer,
president of the British Vir-
gin Islands Hotel and
Tourist Association, states,
"We don't want production-
line tourism. The British
Virgin Islands are for the
discriminating traveler.
What we are is a small sam-
ple of the Caribbean as it
used to be — with secluded
beaches, small inns and
friendly people."

TOLA — Though Tortola
may sound like a spicy Mex-
ican dish, it's actually the
principal island in the BVI
and home to some 9,000
people. But unlike many a
so-called island paradise,
tourists here are not

comed. -
There is also apparently
very little political unrest or
demand for independence in
this tropical archipelago. Or
as one BVI'er commented on
this subject: "Indepen-
dence? For what? And if we
get it and we don't like it, to
whom can we give it?"

Of course, the sun and
water here are the message.
And the biggest attraction,
after tranquility and seclu-
sion, is sailing. Tortola, for
example, boasts the world's
largest fleet of uncrewed
sailboats and_yachts for
charter. There is also a cir-
cuit of beautiful places to
visit, all within an easy
day-sail of each other.
For openers, there's Nor-
man Island, reputedly the
Treasure Island in Robert
Louis Stevenson's novel.
And Dead Chest, where
Blackbeard is said to have
marooned 15 of his crew.
Other islands bear descrip-
tive names like Virgin

JEWISH LIFE IN THE
BVI. Certainly there is no
organized Jewish commu-
nity here; nor is there a
synagogue. And though a
handful of Jews apparently
own small hotels on several
islands, their identity — as
Jews — is not usually evi-
dent. Suffice to say, a mi-
nyan here would probably
prove difficult.

Nonetheless, it's entirely
possible that Tortola was
discovered in 1493 by a Jew
— namely Christopher Col-
umbus! If this claim seems
far-fetched, consider
Charles Alerpin's thought-
provoking article in the
March 1979 issue of
Midstream. His conclusion:
that Columbus was "a
member of a Jewish family
of so-called Vonersos." The
evidence he cites includes:
Columbus's secrecy as to his
origins; his use of Jewish
phrases and references; and
the fact he never wrote in
Italian. An intriguing
hypothesis, isn't it?
