Cohn Honorary Chairman raised by the exposures would be that "there is no Jewish crime wave." A socio-economic analysis "would reveal only a meager amount of crime" among Orthodox Jews. But from a Jewish religious law perspective, he added, a "most vexing problem arises. How could such things happen? What can be done?" While making it clear that self-policing remains an unsolved problem, Davis wrote that "If Jewish his- tory is to serve asa guide to solving current ethical di- lemmas, self-policing is only a first step. Following past practice, the Jewish community should now con- front and challenge ac- tivities that fall short of criminal but are morally repugnant, for example, slander, unsavory business practices and racism." One problem, Davis wrote, 'is that many Jews are still afraid of 'the outsider' — the shadowy figure that rep- resents the non-Jew sit- ting in judgement. While revelations of Jewish corruption led to numer- ous public statements, none were as noteworthy as private expressions of fear." He declared that "if that paralysis" wore off, "the truly important response" will follow. "by word of mouth," in these "clear and simple terms: the Jewish criminal threatens the moral survival of the Jewish community. His ac- tions will not be condoned." Yosher's programs deal- ing with kashrut and educa- tion are important but ap- peared unlikely to have any immediate effect on the basic problem of criminal behavior -which spurred formation of the two-year- old organization. Davis disagreed with a JTA suggestion that teach- ing midos (ethics) in yeshivot was not likely to have any immediate impact on the problem. He pointed out that such teaching at the high school level in yeshivot was a program aimed at Jewish youth soon to become adults. Davis said Yosher has discussed the problem of ,wider availability of ethics courses in day schools with the Board of Jewish Education and Torah Umesorah, the Society for Hebrew Day Schools. But the barriers to creation of an effective climate of Jewish opposi- tion to and rejection of Jewish malefactors are formidable. In this area, Yosher is seeking to en- list the help of religious courts. One of the barriers is that Halakha bars mention pub- licly of the names of Jewish suspects. Davis said that be- fore he added the names of Bernard Bergman and Eugene Hollander to his "Present Tense" report, he asked an Orthodox rabbi if this was permissible and that he was told that, in view of the widespread pub- licity about the two men in the general media, it was permissible.
