Pfeffer testified that the Packwood-Moynihan bill was "irremediably uncon- stitutional" as it relates to tuition at elementary and secondary schools. How- ever, it could "pass constitu- tional muster" in respect to colleges and universities if modified to exclude tuition to seminaries and other church-related institutions that inculcate religions be- liefs or require attendance at religious services, he said. The bill—S. 2142— provides an income tax credit, to be subtracted directly from the taxes owed, for tuition ex- penses paid by the tax- paye himself, his spouse or lftdependents.
