Sen. Proxmire made his charges in a letter sent last Friday to Rep. Benjamin Rosenthal, (D-NY), whose subcommittee was sched- uled to open hearings on the guidelines Tuesday. The let- ter was disclosed by The New York Times. Sen. Proxmire denounced particularly two provisions of the regulations which_he listed firms and keep them from competing for trade in the Arab world, thus cre- ating a "whitelist" of disr advantaged American firms. He said the use by Ameri- can firms of the "risk of loss" provisions in contracts would raise "a presumption of illegality." (committee in formation) Commerce Dept. regu- lations say that use of that provision does not, in and of itself, represent compliance with the boycott. Proxmire also assailed a regulation which deals with the much-debated "unila- teral election" provision of the law. The proposed guidelines say that firms can provide information to facilitate a purchaser's choice of subcontractors, provided they do not exclude blacklisted firms. But Sen. Proxmire said pro- viding such a list may help the purchaser enforce the boycott. In accouncing the hear- ings, Rep. Rosenthal said that the projected regu- lations might create loo- pholes which would permit firms "to comply with the Arab boycott in ways unin- tended by Congress." Meanwhile, the Depart- ment of Commerce has repudiated and ordered the retraction of a discrimina- tory advertisement for employment in Saudi Arabia published in the Placement Bulletin of the U.S. Merchant Marine Academy. The action was taken in response to a com- plaint from the Anti-Defa- mation League of Bnai Brith. According to Arnold For- ster, ADL associate director and general counsel, the Academy's Placement Office Bulletin had printed an advertisement which stated that applicants for a job on a ship anchored off Saudi Arabia "must be able to obtain a Saudi visa." The Saudis do not grant visas to Jews. The advertisement was published in behalf of a private employer in San Francisco. The ADL complaint, addressed to the Maritime Administration of the Department of Commerce, pointed out that a Presiden- tial directive, a memo- randtun from the Secretary of Labor, and official regu- lations issued in February by the Office of Federal Contract Compliance Pro- gram prohibited the pub- lication of such discrimina- tory requirements for employment of Americans overseas.
