Judge Francis J. • Boyle ruled last Friday that the election. scheduled by city law for the first Tuesday after the second Monday in September. has to be post- poned because it fell on Rosh Hashana. Dennis Rapps. COLPA ex- ecutive director. said an ap- peal by the city was pos- sible in theory. but in prac- tice the time element would prevent an appeal from being heard by the federal court of appeals before Sept. 15. Rapps said he as- sumed the Newport Board of Canvassers was pro- ceeding to prepare the ma- chinery for a Sept. 15 vote in accordance with Judge Boyle's decision. Boyle said the case was a direct clash between - two constitutional rights. The case was brought to him by Assistant Attorney General Allen Rubine on an action by the Rhode Island At- torney General, using his "common power" to act against "a public wrong." Rubine said the conflict in- volved a violation of the Civil Rights Law, making it a federal issue. Newport Jews had pre- viously appealed to Gov. J. Joseph Garrahy. who asked the Rhode Island Supreme Court to issue an opinion postponing the vote. How- ever. the court said it was bound by the wording of the law. which permits post- ponements of primaries but not general elections and re- jected the request. Marvin Holland. presi- dent of the Jewish Feder- ation of Rhode Island. said in a statement to the Jew- ish Telegraphic Agency. that "we have received the assurance of the Governor. and the Speaker of the House and the Senate Ma- jority Leader that the law will be corrected in the next session of the Legisla- ture" to avoid such con- flicts. In Rochester. New Hamp- shire. Mayor John Shaw has said that he will help Jewish residents of his city circumvent a state law that would prohibit theth from voting by absentee ballot in the municipal primary elec- tion. scheduled for the first day of Rosh Hashana. State law prohibits distri- bution of absentee ballots on religious grounds; bal- lots may be obtained only by those physically disabled or out of town on election day. However. Shaw said that any Rochester Jew attend- ing holiday services at the closest synagogue—in neigh- boring Dover about 10 miles away—would be out of town and therefore eli- gible for an absentee ballot.
