Nazis Banned From Wearing Swastikas in Village of Skokie

SKOKIE, Ill.—Nazi party
members were barred from
displaying the swastika in
any march or demonstra-
tion in the prominently Jew-
ish suburb of Skokie by the
Illinois Appellate Court.
In so doing, the court up-
held part and reversed part
of a temporary injunction is-
sued April 29 by the Cook
County Circuit Court. The
lower court injunction
would have prevented the
National Socialist Party of
America, the Nazi party,
from marching in Skokie,
with or without uniforms
and with or without the
swastika symbols.
In effect the court upheld
the lower court's ruling
that the wearing of the
swastika could constitute a
"grave and serious threat
to the peace of the citizens
of the village of Skokie." It
said the swastika con-
stituted "fighting words"
unprotected by the Con-
stitution. •
The
Appellate
Court
acted after the United
States Supreme Court ruled
June 14 that the Nazis had
a right either to a stay or
to an immediate review.
By its ruling, the Appel-
late Court sent the case
back to the lower court for
modification in accordance
with a 24-page opinion ex-
plaining its findings.

"The evidence conclusively
shows that at least one resi-
dent of Skokie considered
the swastika to be a person-
ally abusive epithet which
was, in light of his personal
history, inherently likely to
provoke a violent reaction
in him if the swastika was
intentionally displayed by
the defendants in the Vil-
lage of Skokie.
"If the swastika would
naturally offend thousands
of Jewish persons in
Skokie, then it must be said

that it would offend all
those who respect the hon-
estly held faith of their fel-
lows, including the ordinary
citizen," the court said.

testified Tuesday that he
and 11 other members of
his sect were acting as
"servants of God" who had
undertaken a "holy war"
against the "Zionist Jews"
in seizing hostages at three
buildings in Washington last
March.

Khaalis, on trial for the
takeover of the buildings
which included the head-
quarters of Bnai Brith
where more than 100 per-
sons were held hostage for
39 hours, accused the "Zion-
ist Jews" of plotting the
death of his children
through "letters used by
the Black Muslims." He
said Elijah Muhammed, the
late leader of the Black
Muslims, was a "Zionist
Jew."

Asked whether he was
aware of the illegal nature
of his actions, Khaalis re-
plied: "my faith and my
country come first. What
the Zionists are doing ex-
ceeds anything that was
done. It had to be done."

In addition to holding the
hostages at the - Bnai Brith
building at gunpoint, the Ha-
nafis also verbally and phys-
ically abused their victims,
wreaked havoc in the of-
fices and left the place in a
shambles with damage esti-
mated minimally at
$250,000. The gunmen also
seized the Islamic Center
and the District Building
(city hall) where another 27
hostages were held. During
their rampage the Hanafis
fatally shot Maurice Wil-
liams, a 22-year-old report-
er for the Howard Univer-
sity radio station, when he
entered the District Build-
ing and surprised one of the
terrorists.
