Nearly 100 witnesses from eight countries are scheduled to testify, but those from the Soviet Union and Poland will not be avail- able before October. Menten, 77, a millionaire Dutch art dealer, was for- mally charged with having killed or having ordered the killings of more than 200 Polish citizens, mostly Jews, in the Lemberg area of Galicia in July and Au- gust, 1941, when he alleg- edly served as an SS offi- cer. The first prosecution wit- nesses to take the stand were Haviv Kanaan, an Is- raeli journalist whose arti- cles over the past year were credited with having exposed Menten's Nazi past, and his cousin, Minna Cygelsreich of Tel Aviv. The court also heard from Johan Van Den Leeuw, of the Netherlands State Institute for War Documentation, who de- scribed the ethnic composi- tion in Galicia before and after the outbreak of World War II and the activities of the various "Einsatztrup- pen" and "Einstzcom- mando" (special com- mando troops) which oper- ated in the Lemberg area under the command of Ober- fuehrer Erich Schoengarth. Testimony was also taken from two Dutch police offi- cers who have been in charge of the Menten case since last summer. Menten fled Holland on Nov. 15, 1976, one day be- fore police called at his lux- ury villa at Blaricum with an arrest warrant for ques- tioning on his war-time ac- tivities. He is believed to U.S. Communist Party Attacks N.Y.Yiddish Daily NEW YORK—The Com- munist Party U.S.A, pub- lished a 2,000-word attack May 14 against the leftist New York Yiddish daily, Morning Freiheit, and its editor, Paul Novick, as hav- ing slid in the last decade into "open service in the in- terests of United States im- perialism." The attack followed sim- ilar denunciations of Frei- heit in the March issue of the Moscow Yiddish month- ly, Sovietish Heimland, whose editor, Aaron Ver- gelis, accused the Freiheit of having "a petty- bourgeois and middle-class base." Novick, 85, was a co- founder of Freiheit in 1922. He was a member of the Communist Party until ex- pelled in 1972 after charges alleging "opportunistic capi- tulation to the pressures of Jewish nationalism and Zi- onism." Novick denounced the at- tack and asserted, "We are for socialism. We are for the Soviet Union the way it was during the Lenin period when Jewish culture flou- rished." He added, Freiheit had called for restoring rights for Jews in the Soviet Union instead of "forced as- similation," and "we are not going to keep silent about anti-Semitic articles." Freiheit has called for Is- rael's right to exist but also for a Palestinian Arab state. • Freiheit has reported that current campaign seeking contributions to sustain the paper has been bol- stered by the Sovietish Heimland attack. - have been tipped off that his arrest was imminent He was apprehended by Swiss police near Zurich on Dec. 6 and returned to The Netherlands on condition that he would not be extra- dited to a third country for trial.
