Israeli origin of goods and
statements concerning the
non-existence of certain
commercial relations with
Israel at the time of certifi-
cation."
Maslow also quoted a let-
ter of Jan. 16, 1976 that he
received from DuPont ac-
knowledging that "certain
purchasers of DuPont prod-
ucts who are located in
Arab countries have stipu-
lated as conditions of pur-
chase that the goods not be
shipped in Esraeli vessels
or other blacklisted ves-
sels...."
Maslow said the letter
also admitted that DuPont
had indicated to purchasers
that it did not have a
branch in Israel and that
particular goods sold to an
Arab purchaser did not con-
tain Israeli raw materials.
The proposals submitted
by the AJCongress stock-
holders wanted to know
what steps the company
will take to prevent discrim-
ination against any Jewish
executive, employee, appli-
cant for employment or sup-
plier as part of its efforts to
obtain business from Arab
interests; whether the com-
parfy would reject a request
or instruction from an Arab
customer to refuse to do
business with an American
firm now on the Arab black-
list; whether the company
has agreed or will agree
not to establish a plant in Is-
rael or enter into licensing
agreements with Israeli
companies; and what steps
the company has taken ,to
assure that its officers.
agents and employees will
not tacitly refuse to do busi-
ness with blacklisted firms
or with Israel.
In urging rejection of
these demands, the DuPont
board charged that they
were "an attempt to politi-
cize our annual meeting"
and are "not in the inter-
ests of our stockholders."

opment, three national Jew-

memorandum opposing the
U.S. Justice Department's
proposed settlement of its
antitrust action against the
Bechtel Corp.
The agencies—the Ameri-
can Jewish Committee, the
American 'Jewish Congress
and the Anti-Defamation
League of Bnai Brith—filed
the memorandum. asking
the Justice Department to
reconsider. with the Anti-
trust Division within the 60-
day period provided by law
for comments on the pro-
posed decree. which cannot
take effect unless found to
be in the public interest.
The Justice Department's
action, brought in January,
1976. challenged Bechtel's
participation in the Arab
boycott of Israel as an un-
reasonable restraint of
trade in violation of the
Sherman Act. The, depart-
ment's proposed final judg-
ment was issued last Janu-
ary. The outcome of the
case may be used as a
guideline by all companies
involved in transactions
with Arab nations.
According to the three
agencies. portions of the
Justice Department's pro-
posed settlement con-
travene U.S. public interest

and policy and permit° the
American-based, inter-
national engineering and
construction firm to contin-
ue the practices objected to
in the first place.
The decree is not accept-
able, the three agencies as-
sert, because it "fails in the
elementary task of pre-
venting continuation and re-
currence of the alleged vio-
lation...fails to prohibit
Bechtel's participation in,
and implementation of, the
Arab boycott of U.S. firms"
and "in effect explains to
Bechtel how to continue to
participate."
The memorandum cites
the following as "the princi-
pal defects - in the pro-
posed settlement:
• It allows Bechtel to en-
gage in conduct which im-
plements and facilitates boy-
cott transactions in United
States commerce;
• It allows Bechtel to en-
force the boycott outside
the United States in non-
Arab League countries;
• It allows Bechtel to enter
into contracts outside the
U.S. to boycott U.S. black-
listed persons.' even though
there could be substantial
impact on U.S. commerce;
• It unduly limits the scope
of relief by its definition of
"U.S. Blacklisted Persons"
and, in effect, permits Bech-
tel to boycott persons who
are fully entitled to the pro-
tection of U.S. antitrust
laws;
• It fails to explicitly prohi-
bit Bechtel from providing
certificates attesting to the
exclusion of blacklisted or
boycotted persons; and
• It contains unwarranted
provisions for the benefit of
Bechtel.

Anti-Boycott Bill
to Be Introduced

LANSINGSen. John R. Ot-
terbacher (D-Grand
Rapids) said he will in-
troduce a bill Tuesday de-
signed to prohibit com-
panies operating in Mich-
igan from complying with
discriminatory trade poli-
cies of foreign persons, gov-
ernments. or international
organizations as a condition
of doing business. He said it
was aimed at thwarting the
Arab boycott.
Besides making it illegal
for Michigan companies to
stop dealing with other
firms on the basis of race,
creed, religion. national ori-
gin or foreign trade relation-
ships. the Otterbacher meas-
ure would carry the same
prohibitions concerning dis-
crimination against persons
when hiring or promoting.

Sen. Otterbacher has
been working closely with
Sen. Daniel Cooper (D-Oak
Park ), who has introduced
other anti-boycott measures
in the state Senate.
