'automatic heir", do some- thing thoughful for a friend, establish a memorial, or help a worthy cause? If the answer to any of these questions is YES, then she needs a will. Let's discuss some typical situations which will help us understand the reasons why a woman needs a will. When she is single. An unmarried woman needs a will because without one, her estate goes auto- matically to the "closest rel- ative" as defined by the laws of the state. That definition varies. Some states favor brothers and sisters over parents, but in Michigan it's parents. An unmarried woman, through written document, can decide how her property shall be dis- tributed. When she is widowed or divorced, with small chil- dren. Without a will, her estate would go to her children — but not directly — if they are minors. The court would appoint a guardian who would administer their as- sets. If there is no will nam- ing a guardian, the court would probably appoint a close relative, but not neces- sarily one who would be picked as suitable by the mother. Court-appointed adminis- trators and guardians may grant funds from the moth- er's estate too sparingly, wishing to keep the assets intact as much as possible for the child to receive when reaching adulthood. Yet many parents would prefer to provide generously dur- ing childhood, feeling that the grown children can take care of themselves. A will can name a guardian, and can give your executor more free- dom in caring for your children. It can help one child more than another if necessary. One of the ad- vantages of a will is that it can stipulate that a trust be established to provide for the financial require- ments of the children. A (NAHP).
