ADL Wins Trademark Lawsuit Over Mexican-American Unit NEW YORK — A federal appeals court in Washing- ton has ruled in favor of an Anti-Defamation League of Bnai Brith action to stop a Mexican-American group from using the phrase "Anti-Defamation Commit- tee" in its name in order to carry out "its own laudable purposes." In its decision (handed down April 7) against the National Mexican-American Anti-Defamation Commit- tee, the U.S. Court of Ap- peals for the District of Col- umbia Circuit said that "the qualifying words are likely to lead the public, or rele- vant portions of it, to con- , sider" the group "a branch of the old and well-known Anti-Defamation League of Bnai Brith." The appeals court opinion also said that "the coined term 'anti-defamation' " ori- ginated with_the Anti-Defa- mation League of Bnai Brith and since its founding in 1913 "had earned in the public mind a definite and especially close association" with the activities of ADL. According to Seymour Graubard, national chair- man of the ADL, the rul- ing, which overturned a lower court finding, • . .• 'A S. .1 J marked the national hu- man relations agency's third successful effort. to protect its name. ADL obtained decrees from the New Yofic State Supreme Court in 1967 bar- ring the American-Italian Anti-Defamation. League and in 1972 barring the Arab Anti-Defamation League from using those corporate names. In the latter case, the court called the use by the Arab group of "Anti-Defa- mation League" in its name "an unfair and illegal usur- pation, exploitation and ap- propriation of plaintiff's (ADL) basic identifying cor- porate name and title and plaintiff's good will and property rights." jwv YETZ-COHEN POST AND AUXILIARY will meet 9 p.m. Monday at the JWV Memorial Home.
