Prof. Ben-Dak is a senior
teaching fellow at the University
of Michigan and -a sociologIst at
the university's Center for Con-
flict Resolution, where he recent-
ly taught a course on the Middle
East situation. Representing him
was the Ypsilanti firm of Bron-
sou and Egnor.
Prior to the symposium, spon-
sored by the Organization of Arab
Students, Ben-Dak had distributed
a pamphlet which he had written,
commenting on the qualifications
of the program participants. When
Hochman learned of the distribu-
tion of. the pamphlet, which was
none - too complimentary toward
him, he and the other symposium
participants insisted that Ben-Dak
comment on the allegations from
the podium.
Ben-Dak at first declined, but
at Hochman's insistence repeated
the statements made in the pamph-
let. These included Hochman's
hatred of Israel (evidenced in
writings and speeches), his own
joking references to unhappy en-
counters with Israeli__ women and
a lack of qualifications in regard
to analysis of the Middle East
situation. -
At this point, Hochman ordered
B'en-Dak off the Podium, and he
subsequently filed suit for libel
and slander.
Judge Ager ruled that Hochman's
complaint alleged no specific
claims of malice, only a general
claim of malice.
Citing an earlier Michigan Su-
preme Court case, that of Nuyen
vs. Slater, Judge Ager repeated
that finding: "a general allegation
that the writing and its publications
were done maliciously- is insuffi-
cient"

Hoebman's motion for accele-
rated judgment was denied, and
the court affirmed summary
judgment for the defendant
Judge Ager gave Hochman 13
days to amend his plea to allege
specific acts of malice by the
defendant, but Hochman did not
reply. The suit was dismissed.
