That principle, incorporated in
the amendment which passed its
first reading in the Knesset last
week, aroused the ire of Orthodox
elements here who opposed equal
treatment for immigrants whose
religious law does not recognize
as Jews. Rivlin said that in cases
where there are doubts, the Jewish
Agency acts to facilitate conver-
sions.
The controversy surrounding
the "Who Is A Jew?" debate
has come at a most unfortunate
time, according to Minister Leon
Dulcin in an interview that ap-
peared in the Tel Aviv daily,
Ha-areta.
Dulcin declared that there is
grave danger of a rift among the
Jewish people in the Diaspora and
that the first signs of that cleav-
age are already evident. American
papers are full of reports about
conflicting positions taken, on the
one hand by the Reform movement
and on the other hand by Ortho-
dox groups.
"There is a fundamental ques-
tion," said Dulcin, "as to whether
the Knesset has any moral right
at all to deal with this problem
which affects all the Jewish peo-
ple, without offering an opportun-
ity for representatives of the Dia-
spora to express their views."
The minister proposed that the en-
tire matter be shelved and that
Israeli citizens be excused from
indicating their "nationality."
In Dulcin's view there is grave
doubt whether this generation is
qualified to make the kind of radi-
cal decision on a very basic ques-
tion of who is and who is not to be
considered as "Jewish", which the
Knesset legislation purports to do.
The state of Israel is a Jewish
state rather than merely a state
for Jews, Dr. Abraham T. Katsh,
president of Dropsie University,
Philadelphia, commenting on the
controversy, said.
While the new state may not fol-
low the dictates of orthodoxy, said
-Dr. Katsh, neither does it uproot
traditional orthodoxy. He pointed
out that the new laws, civil and
criminal, the observance of feasts
and fasts, as assumed by everyone
acquainted with the Jewish past,
have a Jewish meaning and char-
! acter indigenous to the revitalized
land of the Bible.
"The concept of freedom of re-
ligion is strengthened when the
same right is also given to those
who are not religiously inclined,"
said Dr. Katsh. "Since marriage,
divorce and other civil acts are
governed in Israel by rabbinic
laws as functionaries of the state,
I do not see why there should not
be two classifications—one for
'real' Jews who were born Jews
of a Jewish mother or converted to
Judaism, and one for 'non-identi-
fied' (unclassified) Jews who mere-
ly profess their Jewishness but
lack the halakhic (religious) quali-
fication.
"The choice to which classifica-
tion a citizen in a democratic Is-
rael is entitled, will then be left
to the individual As a citizen pro-
fessing 'limited' rights, one can
go on living his way of life as a
'non-identified Jewish Israeli', fol-
lowing his own choice. Should he,
however, wish to benefit from
those civil laws which are subject
to rabbinical jurisdiction, he would
have to submit himself to these
courts, since they are approved by
the state. In doing so, he would
naturally have to become a Jew
according to the rabbinical laws."
