Israel's Religious Status Inspires Conflicting Views

WASHINGTON—American Jew-
ish liberals are apparently more
concerned about the failure of
Israel to separate the synagogue
from the state than are prominent
U.S. judges and attorneys of the
American Judicature Society.
The Judicature Society, repre-
senting 38,000 judges, lawyers, and
laymen concerned with the ad-
ministration of justice, has just
examined the Israeli legal system.
Editor Glenn R. Winters of "Judi-
cature," the journal of the society,
was deeply impressed by his in-
vestigative trip to Israel. The re-
port is entitled: "Israel's Courts
Live Up to Proud Heritage."
But another organization, "The
American Friends of Religious
Freedom in Israel," simultaneous-
ly released an attack on the com-
promises of Israeli law to theo-
cracy. Prof. Horace M. Kallen,
president of the group, charged
that Israel had failed for 20 years
to honor its pledge to guarantee
full rights to all "without distinc-
tion of religion, race, or sex."
The Kallen statement asserted
that "in modern-day Israel, select-

ed state-sanctioned religious hier-
archies have exclusive jurisdiction
over all matters of personal sta-
tus. Mixed and civil marriages are
not recognized, and since Ortho-
doxy is the only sanctioned Jew-
ish denomination, neither are mar-
riages performed under Conserva-
tive or Reform auspices. Women's
rights are curtailed in accordance
with Orthodox law. Orthodox reli-
gious observance is imposed on all
citizens, regardless of their own
belief, in the nation's public in-
stitutions, its schools, and even its
armed forces." Prof. Kallen ques-
tioned whether Israel was not, in
effect, violating the articles of the
Universal Declaration of Human
Rights.
The synagogue-state issue in
Israel was dramatized by a recent
"Halakhie" ruling of Israeli Chief
Rabbi Itzhak Nissim. To the em-
barrassment of Israel's diplomats,
the chief rabbi decree that "It is

forbidden by the Tora for all Jews,
including the Israeli government,
to return even one inch of the ter-
ritory of Eretz Israel now in our
hands."
Editor Winters of "Judicature"
said the proclaimed policy permit-
ting Jews to claim Israeli citizen-
ship merely by establishing resi-
dence in Israel "has presented the
judiciary with its greatest chal-
lenge since independence." He
cited the pending case of an
Israeli whose lineage is Jewish,
but who says he has no religion at
all. The highest court of Israel is
now deciding whether an atheistic
or agnostic Jew has a right to be
an Israeli citizen.
Winters concluded that "There is
complete religious liberty in Is-
rael" because "there are many
flourishing Christian churches,
Catholic, Protestant, Greek, Ar-
menian, Coptic and others, as well
as Moslems and other faiths."

U.S. Nazis' Anti-Israel Phone Drive
Draws Congressional Bid for Probe

WASHINGTON (JTA)—A tele-
phone campaign by the "National
Socialist White Peoples Party,"
formerly the American Nazi Party
headed by the late George Lin-
coln Rockwell, has embarked on
such extreme denunciations of
Israel that a Congressional re-
quest for an investigation was
made Wednesday.
Following the U.S. and UN con-
demnations of Israel for the Dec.
2/1 reprisal action at Beirut air-
port, the rightists recorded a tele-
phone message assailing Israel and
the Jewish people. By dialing a
widely advertised number, the

caller would hear a spokesman for
the party state that "A hydrogen
bomb on Tel Aviv right now would
be an excellent and a just way of
settling the entire Middle Eastern
problem."
The message charged that the
"Politicians who run the United
States . . . are totally under
the influence of the enormously
powerful and well organized

Jews in this country."

It said that after "a timid slap
on Israel's wrist, our government
will deliver to the Jews still more
military equipment, including 50
Phantom jet fighters, to be used
for further Jewish aggression
against the Arabs."
The Nazis stated in their record-
ing that by the reprisal at Beirut,
"the Jews once again displayed
their colossal arrogance and total
contempt for all the non-Jewish
peoples of the world—or 'goyim,'
as they sneeringly call us."
Citing Israel's justification for
the Beirut action, the Nazis said,
"By this kind of reasoning, the
U.S. would have been more than
justified in wiping Israel off the
map with hydrogen bombs in June
1967, as the Jews made their mur-
derous attack on the USS Liberty,
deliberately killing 39 American
sailors."
Rep. Seymour Halpern, New
York Republican, said that "Such
racist incitements appear to vio-
late federal regulations governing
public utilities and interstate com-
munications." He said that he is
requesting the appropriate federal
agencies to determine whether gov-
ernment-licensed telephone facili-
ties can be "used for the irrespon-
sible dissemination of slanders,
racist incitements, and such fla-
grant appeals to anti-Semistim."
A tape recording system is used
to reply to the callers who tele-
phone the advertised number. The
matter is under investigation by
the regional office of the Anti-
Defamation League of Bnai Brith.

Marvin Mandel
New Governor
of Maryland

ANNAPOLIS (JTA)—A Jew was
named governor for the first time
in the history of Maryland with
the election Wednesday of Mar-
vin Mandel, Baltimore Democrat,
by the State Senate and House of
Delegates to succeed Vice Presi-
dent-elect Spiro Agnew.
Mandel received more than the
necessary two-thirds votes of the
State Legislature.
He served previously as speaker
of the House of Delegates. A
leader of the Baltimore Jewish
community, Gov. Mandel is very
active in the Associated Jewish
Charities, the Israel Bond cam-
paign, synagogue groups, the Men-
orah Lodge of Bnai Brith, and
other Jewish organizations. He is

Maryland's 56th governor.
