NEW YORK (JTA) P a ul State, charged Tuesday that "lurk- mation of Abe Fortas as chief jus-

for the Senate from New York of Senate hearings on the confir-
The New York Times reported
that sources in the office of Sen.
Jacob Javits, New York Republi-
can who is seeking re-election,
had called a number of influential
Jews around the nation to assure
them that Senator Robert P. Grif-
fin, Michigan Republican, who • is
leading the campaign to block the
confirmation of Fortas and Su-
preme Court nominee Homer
Thornberry, was not anti-Semitic.
The Times reported that the
calls- were assertedly made at the
request of Sen. Griffin, who "had
expressed concern that he was
being tagged as an anti-Semite,
since Justice Fortas would be the
first Jewish chief justice."
Prof. Fred Rodell of the Yale
Law School was quoted as saying
that "a couple of Fortas' colleagues
on the court have told me that
they haven't the slightest doubt
that one of the objections is the
fact that Abe is Jewish. It may
not be the whole thing, but it's
definitely there." He declined to
name the colleagues.

After-Convention- Delay Is Possible
ill Senate on Fortas' Nomination

Crowd gathered as Abe Fortas left the U.S. Senate Judiciary
Committee hearings after considering his elevation to the chief
justiceship.

And I will taste no other wine

Predictions in Washington are
that President Johnson's appoint-
ment of Supreme Court Justice
Abe Fortas as successor to Chief
Justice Earl Warren is taking on
a struggle for separation of pow-
ers, affecting administration poli-
cies.
It is believed that it will not
be difficult to secure a two-thirds
vote to stop- a filibuster and that
the consideration of the appoint-
ment may be postponed until after
the Republican convention which
will open in Miami on Aug 5,
Senator Wayne Morse has read

into the Senate Record a tele.
gram from 480 dems and profes-
sors of law schools rejecting the
argument that because President
Johnson is not running for re-
election he can not make judicial
appointments.

Senator Philip A. Hart of Mich=
igan, who supports the Fortas ap-
pointment, presented a 27-page
memorandum on Fortas' record.
It was prep _ ared by the Justice_
Department and declares that Mr.
Justice Fortas "deserves extremely
high marks" for his court record.
Senator Everett Dirksen, who
backs the Fortas appointment, now
says he is not sure a filibuster
can be stopped.
