Studies are still being made among Jewish halakic scholars regarding the transplanting of human organs from the dead to the living. These prohibitions include such things as deriving any benefit from the dead, desecrating the corpse which should ideally be left fully intact, and preventing the burial of the corpse or any part of it. In the case of the heart transpant, Jewish law would definitely re- quire that the rest of the corpse and any part of the heart itself which is not used should be buried in the proper manner as soon as possible. There are a number of related issues that raise interesting ques- tions in Jewish law, such as the question of when the donor is con- sidered officially dead, and the re- quirement of shiva of the next of kin in the case of a deceased whose corpse has not been fully buried. Each case is generally to be judged on its individual merit. It is interesting to note that there has been a tendency of many rabbis to permit corneal trans- plants in accordance with Jewish law. although it should be stated in all fairness that there have been written opinions forbidding such a procedure. Some of the opinions rendered carry an explicit declara- tion by their a uthors that the opinion is relatively academic and that one should seek the judgement of a competent rabbi in each par- ticular case for the practical appli- cation of Jewish law to each in- stance.
