Agudath Israel Defends Stand on NY Constitution (Direct JTA Teletype Wire to The Jewish News) NEW YORK — An Orthodox spokesman charged Tuesday that the position of New York Jewish citizens on the proposed new con- stitution "is being misrepresented." He denounced reports that "in- variably portray the Jewish voter as opposed to the constitution, which is projected as a Catholic document." The most controversial aspect of the proposed new charter which is being submitted to the electorate on Tuesday is its elimination of the Blaine Amendment, 73-year-old prohibiting use of public funds for religious schools. In its stead, the new draft re- peats the First Amendment of the federal Bill of Rights and gives taxpayers the right to challenge in the courts expenditures which he considers violate the principle of church-state separation. Rabbi Morris Sherer, execu- tive vice president of the Agu- dath Israel of America, national Orthodox Jewish movement, said that what was at stake was "an American issue of freedom of choice in education" which, he said, every Orthodox Jewish organization in the state sup- ported. Printed in English and Yiddish, the leaf- lets charge that the Blaine Amend- ment "discriminates against Yesh- iva children." The Central Conference of Amer- ican Rabbis, the Reform rabbinical association, joined last weekend the growing number of Jewish or- ganizations opposing approval of the new constitution. Rabbi Edward E. Klein, chair- man of the church-state committee of the CCAR, said in the announce- ment calling for a negative vote on the charter in the Nov. 7 referen- dum, that repeal would make "a shambles out of any public school integration program." The Workmen's Circle and the Labor Zionist Organization of Amer- ica stated that the main reason for their opposition was repeal of Blaine Amendment. The Federation of Jewish Phil- anthropies of New York, the largest voluntary philanthropy in the country, agreed to oppose the proposed New York State Constitution, by a vote of 84-33 on a report of its social legisla- tion committee which held the draft "not acceptable." The committee, chaired by former State Assemblyman Bentley Ka.al, considered those matters that spe- cifically concerned the Federation and its agencies, namely — adop- tions. gifts or loans of state credit, the State Board of Social Welfare, the family court, the state debts referendum and use of public funds in aid of denominational schools.
