Federal Court Permanently Bans
Ruby Wins Trial Outside Dallas;
Nazi Marches Near Chicago Temples Sol Dann Is 'Gratified' at News

CHICAGO (JTA)—George Rock-
well's American Nazi Party is un-
der permanent court order here
to stay away from any synagogue
on the Jewish Sabbath or on Jew-
ish holidays.
Judge Sam Ferry converted a
temporary injunction into a perm-
anent one in federal court here
for the northern judicial district
of Illinois, which covers all of
Chicago and counties surrounding
it Rockwell said he would appeal.
Judge Perry said he based his
ruling on the constitutional guaran-
tee of freedom of religion. He twice
cut Rockwell short when the Nazi
arose to protest at the hearing.
The injunction covers not only
members of Rockwell's group but
also any other person wearing a
Nazi uniform or carrying Nazi

Party paraphernalia, such as
placards or symbols. All such
demonstrations, under the ruling,
are confined to a point beyond
a half-mile from any synagogue.
The initial suit was brought by
the Jewish War Veterans here,
early in September, when Rock-
well announced he would march
into Jewish neighborhoods on the
High Holy Days. Judge Perry is-
sued a temporary injunction for
that period, which he made perm-
anent Friday. Rockwell called the
decision "the most outrageous I
ever have encountered."

AUSTIN, Tex. — Jack Ruby, ac-
cused of murdering presidential
assassin Lee Harvey Oswald, has
won a new trial outside Dallas.
The Texas Court of Criminal
Appeals reversed Wednesday
Ruby's conviction and death sen-
tence, holding that District Judge
Joe B. Brown should have granted
a change of venue in Ruby's trial
in Dallas in 1964.
The opinion of the three-judge
court also held that testimony about
Ruby's statements to police show-
ing premeditation were admitted
in violation of the U.S. Supreme
Court's guidelines on confessions.
Detroit attorney Sol A. Dann,
who has assisted in Ruby's de-
fense, said he was gratified at
the result and congratulated the
Texas Court of Criminal Appeals
"for upholding the laws of Texas
and, more particularly, the laws
as recently set down in decisions
by the U.S. Supreme Court. This
is a victory for the American
people."

Dann had suggested in his briefs
that there were anti-Semitic over-
tones in the Dallas trial; the ap-
peals court did indeed make refer-
ence to this, saying pretrial pub-
licity had mentioned Ruby's name
was changed from "Rubenstein"
to "Ruby."

Ruby's attorneys said they would
attempt to have him tried on a
charge of murder without malice,
which carires a penalty in Texas
of two to five years. Ruby has
already been in jail for three
years.
