LAI Church-State Concessions Are Reviewed in Book

John P. Roche, member of the
faculty of Brandeis University, for-
mer ADA national chairman and a
consultant to the Civil Rights Corn_
mission. the State Department and
the Vice President, in "Courts and
Rights — The American Judiciary
in Action," published by Random
House, outlines the chief issues
that confront our courts and the
nation. Civil rights, church-state
controversies, freedom of assembly
and court procedures are reviewed
here.
Dealing with the basic principles
of religious freedom, he makes the
interesting observation that "inso-
far as our society strives to be sec-
ular in character but still retains
an active sympathy for religious
freedom, it becomes committee to
the paradox of protecting religious
practices when they can be justi-
fied in secular terms.

He shows that "our society has
more or less established a consen-
sual church based upon a civic
religion, the 'Brotherhood of Prot-
estants. Catholics and Jews.' Thus,
the principle of no penalties and
no favors for any or all religious
groups is further diminished in
value as an interpretive guide to
the First Amendment because our
society is simply not that secular."
After reviewing the various
cases that have come up, the
court rulings, the tests, the strik-
ing down of Bible readings in
public schools, Roche states that
"the ancient battle over public
support for religiously supported
and oriented educational insti-
tutions appears to have been
compromised by the Johnson ad-
ministration. Essentially, the
federal government is moving to
support the educational objec-

the citizen and of the democratic
processes are under review in this
interesting book. He emphasizes
as the essence of his defense of
democracy that "it is the one sys•
tern devised to date that is prem-
ised on the manifest fallibility of
man, the one system that assumes
that all men and women (not
merely nobles, rich men, or party
members) are full members of the
community entitled to a voice in its
destinies. The leaders must look
for public sanction, and the people
always retain the right to reject
one set in favor of another. This
right may on occasion lead to de-
magoguery, father images,' and
sheer incompetence, but the alter-
native is a frozen, self-validating
and inevitably dictorial system. As
Winston Churchill once observed
in a moment of pessimism, 'Democ-
racy is the worst system ever in-
vented—except for all the rest.' "
