Rabbi Akiba Wins
in Parliament

It has taken a long time, but
after more than 2,000 years the
English Parliament last week, by
a big vote, adopted a motion by
Rabbi Akiba.
I am referring to the passing of
the bill abolishing the death pen-
alty in England.
To be sure, the bill itself was
introduced by Sidney Silverman.
a Laborite member of Parliament.
It ends a thirty-year fight by Sil-
verman to have the bill passed.
Silverman is a man of no little
brilliance. and a great fighter. He
is a fine Englishman and also as
a good Jew, I am sure. vas aware
of the opposition of Rabbi Akiba
to the death penalty.
As far as I know, Rabbi Akiba

There are those who think that
the death penalty is a preventa-
tive of murder. I doubt that there
will be an increase of murder in
England as a result of the aboli-
tion of the death penalty. There
is sure. however, to be some de-
crease in murder—at least to the
extent that the murders per-
petrated by the state will have
been eliminated. Capital punish-
ment simply doubles the number
of murders. For every murder by
an individual, the state commits
one. Perhaps if the state eschews
such uncivilized violence, there
will be less of other murders as
well as a result of the improved
humane tone of society.
All of this is a matter of simple
common sense, a very uncommon
quality. A hundred years ago,
there were more than one hun-
dred offenses. besides murder. for
which, in England, there was the
death penalty.
Rabbi Akiba is known as the
father of rabbinic Judaism."- His
interpretations of the Torah were
generally known for their common
sense. Perhaps this was due is
part to the fact he started on
his education rather late. He is
Said to have begun his studies at
the age of forty. While those who
,tart late have some handicaps,
there are some advantages too.
They are apt to put more of their
mind into the subject and they
can also skip a good bit. When you-
are forty. you can skip such parts
as, "See the dog; The pussy cat is
drinking her milk; The Dog Jumps
over the fence." The man of forty
is already aware of such things.
When Rabbi Akiba came to his
studies. he had already accum-
ulated quite a degree of common
sense for which there ought to
be a degree given also. It is some-
thing which books cannot give you.

Rabbi Akiba was not only hu-
mane in his opposition to the
death penalty. He was an op-
ponent of the gloom with which
other religionists pervaded their
doctrine. He believed in cheer-
fulness. IV h e n other rabbis
looked on joking and levity as
evil. he regarded them as good.

He tried to see the cheerful
side. When his colleagues visiting
the site of the Temple and seeing
the ruins. broke down and wept,
