Spain's Religious
Freedom Claims

Nathan D. Shapiro. a New York
attorney: with offices at 50 Court
St., Brooklyn, this week challenged
the statements that had been is-
sued by Spanish spokesman which
gave the impression. that religious
liberty was being established in
Spain.
In a ' letter to the Spanish
Embassy in Washington, Shapiro
stated:

"Extremism" was a term that
was used so frequently prior to the!
Nove4Inber election, that the term
has become a subject for debate
and study.
A volume of special importance
devoted to -the issue was written
by two distinguished sociologists.
and philosophers, Harry and.
Bonardo Overstreet, whose "The
Stranger Tactics of Extremism,"
published by W. W. Norton & Co.

attention.
The Overstreets hold the view
that one must know how the enemy
to be able to fight him, and they
make this interesting observation:

visiting Spain with Mrs. Shapiro, I
wrote to you about Spain's religious
restrictions against non-Catholics. In
your reply dated November 21, 1962
(Your No 1080/dh) you stated that
"one must, of course, take into Consid-
eration that in a country where 99.9 ,7;•
of the population is Catholic there is a
certain public pressure against the de-
velopment of religious minorities". You
also stated that "Clause 6 of the Span-
ish Charter states that: 'Nobody will be
molested because of his religious beliefs
or the private exercise of his cult'."
I am advised that during the two
years following your letter, no change
was made in the requirement that a
Jew or other non-Catholic cannot prac-
tise his religion in public. This_applies,
of course. to houses of worship, sem-
inaries, religious schools, funerals, wed-
dings, circumcisions, publications, etc.
There are similar provisions in Corn-
munist constitutions which were nulli-
fied by their practices, all of which
were condemned by several Popes as
well as by all freedom-loving people
including Jews, Protestants and Catho-
lics, The Spanish continue these restric
tions in spite of the fact that Pope
Paul VI had urged that religious liberty
be granted in Spain. He also advised
Spain. "Don't be afraid of religious
liberty".
The Encyclical of Pope Pius XI, en-
titled "Atheistic Communism", in Sec-
tion 22 states that "Communism is of
its nature anti-religious". Applying this
principle to Spain I think it could be
correctly stated that Spain is also by
its actions anti-religious as to all non-
Catholic faiths. To further prove this
thought the Encyclical . in Section 26
speaks of "God the Supreme Reality."
Then in Section 27 entitled. "Man and
Family according to Reason and Faith"
says. "In consequence he has been en-
dowed by God with many and varied
prerogatives: the right to life, to bodily
integrity, to the necessary means of
existence; the right to tend toward his
ultimate goal in the path marked out
for him by God". This obviously in-
eludes the God of all faiths.
When in Madrid, and this was a
shocking fact, we planned to attend a
Saturday service in a Temple, only to
be told that there are no such build-
ings in Spain. We were then obliged to
attend the Sabbath services in several
small rooms of an office building with
no identification on the outside of the
building that synagogue services were
conducted.
Friends of mine recently visited Lis-
bon, Portugal, and found that there was
also a small Jewish population. How- ,
ever, they had a very nice house of
worship and their religious services of
every description were conducted open-
ly and without any restriction or con-
cealment.
An editorial in the New York Times
of Oct. 14, 1964, entitled. "Spain and
the Vatican", stated that Spain "has
been more 'orthodox' than the Holy
See". The editorial also states that
"plans to soften restrictions against
Protestants, who only number 1/10 of
of the population, seem to have
bogged down".
I have discussed this problem with a
number of Protestants, Jews and Catho-
lics. They all agree that if 99.9'; of the
Spanish people will miss the profitable
tourist business from about 7,000,000
tourists per annum, of • which about
500,000 are Americans, and who put
about $700,000.000.00 into the pockets of
these intolerant people each year, they
may be more inclined to establish,
rather promptly, the religious freedom
enjoyed in almost all other countries,
except those dominated by the Commu-
nists.
If the non-Catholic religions are to
be punished for their religious beliefs,
then these "pious" people should refuse
to accept the moneys of the Jewish and
Protestant tourists.
Fundamentally I believe that the
tourists who are informed about these
discriminations will show- their resent-
ment by boycotting Spain as they boy-
cott Russia. -
If a Protestant country passed simi-
lar religious restrictions against Catho- .
tics, I believe no self-respecting Catho-
lic would visit such country as a
tourist.
