FRANKFURT, (JTA) — Col. Franz Magill, a cavalry officer in Hitler's Elite Guard during the war, admitted in a court at Brunswick that, in the summer of 1941, he had passed on mass murder orders from Heinrich Himmler, commander of the Nazi SS, resulting in the death of Jews in Pinsk, Byelorussia. Magil, now 63, is one of five former cavalry officers who went on trial at Brunswick on charges of murdering 5,200 Jews during the Nazi occupa- tion of Pinsk. Admitting that he had passed on the Himmler order, which called for the shooting of all male Jews and the driv- ing of all Jewish women into the marshes, Magill however, insisted he had issued such orders "only once." Magil was adjutant to Hans Walter Nenntwich, another SS Cavalry officer, who is the prin- cipal defendant in the Bruns- wick trial. The three others in- volved in that proceeding are Walter Bornscheuer, Walter Dunsch and Kurt Wegener. Bornscheuer sought on Tues- day to pin the blame for the murders on a former SS general who was shot as a traitor on Hitler's orders. A former SS cavalry man, Bornscheuer, as- serted that the order for the killing was conveyed by SS Gen. Otto Herman Fegelein, brother-in-law of Hitler's mis- tress, Eva Braun. Bornscheuer insisted that Fegelein gave in- structions that the order issued by Himmler be carried out in August 1941 despite protests by some officers. Meanwhile, here, in the Frankfurt Municipal Council chamber, the 10-week-old trial of 22 former Auschwitz- B i r k e n a u administrators, guards and medical personnel was resumed after a 10-day recess. Prof. Helmuth Krausnick, of Europe's Jews. He said Hitler had estimated there were 11 million Jews in Europe, and had aimed at their total liquidation through "a methodical pro- gram." He said the Nazis chose Au- schwitz as a major death camp because of its good railway con- nections and the possibility of sealing off the entire area. The Frankfurt trial heard testimony from an Auschwitz survivor, Hermann Langbein, now living in Vienna and head of an international resistance organization with headquarters in Brussels. Pending his appearance on the witness stand, Langbein has issued a demand that the German Medical Association order the disqualification of 24 physicians in this country who, he charges, participated in the Hitler enuthanasia pro- gram. Under the program, about 200,000 persons, most of them Jews, and about 70,000 of them children, were administered "mercy death" injections by German doctors. Dr. Ernest Fromm, president of the German Medical Associa- tion, said that he has ordered local and regional medical societies to probe the charges against the 24 doctors. Dr. Fromm said that some of them are dead, others have already been barred from medical prac- tice, and a few have retired. However, he pledged that full investigations will be made of the Langbein charges and de- clared: "I feel certain that the profession will be cleared fol- lowing this investigation." One of the laws under which the physician is charged stems from Nazi racial legislation that made it illegal for a healthy "Aryan" woman to submit to sterilization. Dr. Dohrn, who has admitted the operations, said he performed them only on the demands of the patients. that he left Germany for Austria in 1948 and that CARITAS, a Roman Catholic Welfare Organization, helped him get a visa for Argentina, where, he added, "I had very good contacts with the Ger- man Jewish Community." He also said that in Vienna the papal Nuncio advised him to go to Argentina and gave him his blessing. In Rome, a Vatican prelate who helped postwar European refugees said that Hefelmann probably used a false name in getting aid from CARITAS. The Vatican had no official comment on the former Nazi's testimony. Hefelmann also testified that he did not want to take part in the Euthanasia kilings, but he was told "I would be treated like a soldier who refused an order" if he declined to par- ticipate. In another trial of Nazis for slayings of Jews in Nazi- occupied Russia, now under- way in Kiel, Karl Strohham- mer testified that "A cere- monial execution" of 400 Jews was staged in Minsk for Him- mler's benefit. He said the killings were done with car- bines and machineguns. He said he was unable to re- member whether Hans Graaife, the former SS officer on trial, had taken part in the killings but — he "could swear" that Graaife had given the order for the executions.
