Jewish Groups Join Opposition to
Con-Con Restrictive Realty Clause
The Jewish Community Coun-
cil appeared with several organi-
zations in a hearing before the
declaration of rights committee
of the Michigan Constitutional
Convention, to present testimony
in opposition to a Con-Con pro-
posal submitted by Weldon 0.
Yeager and entitled "A Proposal
Relative to the Private Owner-
ship of Real Property."
The hearing was arranged by
the Michigan Coordinating Coun-
cil of Civil Rights, with which
the Jewish Community Council is
affiliated. Major testimony was
submitted by Edward M. Turner,
president of the Detroit and
Michigan Branches of the NAACP
and chairman of the Coordinating
Council. His testimony was based
on a detailed "Memorandum in
Opposition" prepared by a com-
mittee chaired by William Co-
hen, a member of the Commu-
nity Council executive committee.
Along with Turner and Cohen,
other members of the special
committee were George E. Bush-
nell, Jr., and Avern Cohn.
The "Memorandum in Opposi-
tion" pointed out five • major ob-
jections to the "private property"
amendment. These were: (1) the
fact that the proposal is statutory
in essence and intent and has
no place in a Constitution, (2) it
would elevate bigotry and dis-
crimination to the level of con-
stitutional principle and proposes
a reversal in state policy of elimi-
nating discrimination, (3) its
adoption would create chaos and
confusion among present laws re-
lating to private property, (4) it
is violative of the 14th Amend-
ment to the United States Con-
stitution, and (5) its adoption
would seriously damage the pres-
tige of the nation as a leader in
the free world.
It was pointed out that the
apparent intent of the Yeager
amendment was to nullify Rule
Nine of the Corporation and Se-
curities Commission promulgated
in 1960 by the then Corporation
a n d Securities Commissioner
Lawrence Gubow as a conse-
quence of the Grosse Pointe reve-
lations. Its purpose' was to elimi-
nate the acceptance of discrimi-
natory listings by real estate
brokers licensed by the State.
The legality of Rule ,Nine has
been challenged by real estate
brokers and the matter is pres-
ently awaiting decision in the
Circuit Court of ,Ingham County.
Research and consultative as-
sistance in the preparation of the
brief prepared by Cohen's com-
mittee was extended by the
American Jewish Congress and
the American Jewish Committee.
In addition to Cohen, as Chair-
man, committee members are
Erwin Ellmann, John Shepherd,
Sol Schwartz and Avern Cohn.
