dau, the presiding judge,
ruled that the affidavit was
hearsay. The prosecution did
not object to the document
but wanted to prove it was
redUndant with citations from
a book published by a Czech
anti-Fascist organization that
the 30 ,children were among
80 gassed in the Chelmno
concentration c a m p, their
names and birth dates being
cited in the book.
Servatius agreed that the evi-
dence was weak but asked its
acceptance so that he might in-
vite witnesses to come to Israel
to testify further on the question
of the fate of the children. The
court ruled that admission of the
affidavit should be deferred to
give the defense an opportunity
to read the book by the Czech
organization:
Eichmann, under questioning,
recalled- a meeting with a Polish
poet, Jochem Klepper, who came
to him to appeal against a forced
divorce from his Jewish wife,
Which was to be followed by his
wife's deportation. Eichmann tes-
tified he did not remember ex-
actly what he told the poet but
that he must have told him that
he was simply following orders in
such situations. The poet com-
mitted suicide immediately after
the meeting with Eichmann.

recall you have not been asked
to give a lecture on this docu-
ment. Please bear this in mind in
all your future replies." The de-
fendant bowed and assented with
a muttered "jawohl."
Eichmann admitted an indi-
rect role in the disposition of
children whose parents were sent
to serve as forced labor in muni-
tions plants. There was some dif-
ficulty about children under 10
who could not be used in the
war plants 'and who, under or-
ders of Gestapo chief Heinrich
Himmler, were to be "deported."
Eichmami said that obedi-
ence to this order would have
required the creation of camps
for children "which was not
the concern of my depart-
ment." Therefore, Eichmann's
department proposed raising
the age limit to 14, thereby
avoiding separation of "the
little darlings" from their
parents. When Eichmann con-
tinued in this vein, Servatius
decided this was too much and
urged him to reply briefly.
The defense plan to portray
Eichmann as a minor functionary
in the vast Nazi machinery for
the destruction of European
Jewry, ran into difficulties dur-
ing Eichmann's third day of testi-
mony in his own defense.
`Obeyance To Superiors'
Eichmann contended Wednes-
day that his Gestapo depart-
ment's usually successful efforts
to evade pressures of foreign
governments for the release of
their Jewish nationals repre-
sented simply another case of
obeying orders from his su-
periors.
Servatius brought up the case
of Gershon Wilner, an Argen-
tine _national who had been in-
carcerated in a Nazi prison in
Tarnow, Poland. The. Nazi For-
eign Ministry had indicated it
wanted Wilner transferred but
Eichmann's department for Jew-
ish affairs in the Gestapo
Bureau IV- shuttled the appli-
cation for Wilner's release back
and forth until Wilner died.
Eichmann, testifying -- for the
seventh day in his.own defense,
said that because of the inter-
vention of the German Foreign
Ministry, "everything possible"
was done to preserve .Wilner's
health "until the matter could
be straightened out." However,
he said, he had to submit a re-
port that- medicine and treat-
ment were unavailing and Wil-
ner died.
