It has approached Congressman Emanuel Celler, New York Democrat, to introduce such a bill, contrary to the opposition of other major Jewish organizations in this country to have a group libel law enacted . . . Congressman Celler, before taking any action, inquired whether a group libel law, if enacted, would do more harm than good . . . He was referred by Joseph Barr, JWV executive director, to views expressed by the American Jewish Congress in June 1940 . . . At that time the American Jewish Congress favored group libel legislation, but the organization has changed its mind since, and has joined the ranks of those national Jewish groups which oppose such legislation . The opposition is based generally on the ground that there is less danger to American democracy and the Jewish community from free dissemination of hate propaganda—no matter how vicious— than from use of government authority to suppress freedom of expression . . The opposing national Jewish organizations are concerned about providing a well publicized public platform for bigots in the course of a public trial.. . Illinois has a group libel law that was upheld as Constitutional by a 5-4 decision of the U.S. Supreme Court in 1951 . There is some talk also in New York of trying to enact a state group libel law . .. A proposed law of this type was recently outlined in the Columbia Law - Review . . Under this proposed law it would become illegal for any person "to utter in a public place any false or defamatory statement of fact concerning a racial, religious, or national group" ... A "defam- atory" statement would be "any utterance which directly, or by innuendo, holds up the group, person or persons concerning whom it is uttered to public contempt, hatred, shame,, disgrace or obloquy" . • Also if it causes the person or the persons affected to be "shunned, avoided, or injured iri his or their business, profession or occupation" . . .
