Neo-Fascist Party in Italy Defeated A Tribute to Dr. Bienenfeld By JOSEF FRAENKEL London Correspondent The World Jewish Congress lost two most distinguished leaders and fighters for the rights of Jews in a very short time - Dr. Isaac Schwartzbart, who died April 26, and Dr. Franz Rudolf Bienenfeld, who died in London May 18. Dr. Bienenfeld belonged to the few Austrian refugees who person- ified the old Jewish tradition of Vienna where Theodor Herzl, Zvi Perez Chajes and Robert Stricker worked and where Jewish "Landespolitik" w a s formulated. . His mother belonged to the orthodox family of Schmelkes, well - known through Rabbi Schmelkes, who was called "the Tzadik of Lemberg", and she was an ardently religious per- son. His grandfather, however, and his father, a famous law- yer, pursued the new "worldly" ideas and thoughts. Dr. Bienen- feld combined these tendencies, as is faScinatingly set out in his booklet "The Religion of the Non-Religious Jews". Bienenfeld studied law, and at the same time, for five years, attended the lectures of Prof. Sigmund Freud. After' 20 years of work he published his book "Die Haf- tungen ohne Verschulden" (Li- abilities without Fault) which received the "Anton Dirl Prize" of the Vienna University in 1933 and is still in use today as a textbook at several uni- versities. One year after Hitler's com- ing into power, the book "Deu- tsche and Juden" (The Ger- mans and the Jews) by Anton van Mueller was published in Vienna and created a sensation. The book was a strong weapon against anti-Semitism. The en- tire press wrote about it and they tried in vain to discover who this "Anton van Mueller" was. The Nazis, of course, were more shrewd, and reacted by trying to kill the author-Dr. F. R. Bienenfeld-by bomb at- tacks. At that time the Austrian section of the World Jewish Congress was particularly ac- tive. Robert Stricker was presi- dent and I was honorary secre- tary. Stricker called a special meeting of all party represent- atives, affiliated to the W. J. C., and proposed that Dr. Bienen- feld should take over the chair- manship of the Austrian sec- tion. This proposal was approv- ed by all parties, and was a demonstration of - their great confidence in Bienenfeld. I re- member the last meeting of Jewish youth of all parties in Vienna and Bienenfeld's fever- ish words and warnings of the impending dangers - a short time later Hjtler was in Vienna. In London"; Zionist veterans fromVienna founded the "Jacob Ehrlich Society" and Bienen- feld became its president. In 1948 Bienenfeld became a member of the World Execu- tive of the W. J. C. During the second world war a Research Department of the British Section of the W. J. C. was established. This depart. ment consisted of three sec- tions, one of which was the "Legal Section" with Dr. Bien- enfeld as chairman. As long ago as 1942, he, together with his colleagues of the W. J. C. worked on legal promulgations, the basis principles of which were later applied •at the "Nur- emburg Trials". The thesis was put forward by Dr. Bienenfeld that valid laws of a sovereign state may nevertheless be crimes in international law. ROME, (JTA) - A draft bill to outlaw the neo-fascist Movi- mento Sociale Italiano, which is represented now in the Italian Parliament, was defeated in Parliament's Interior Affairs Committee here. But the chief sponsor of the measure plans proposing the bill before a plenary session of Parliament, hoping it may still be adopted. The principal backer of the bill is Ferruccio Parri, presi- dent of the Committee for Na- tional Liberation and Italy's first Prime Minister after the liberation of Italy following World War II. A coalition of Democratic Christians and neo-fascists de- feated the draft bill in com- mittee: The opponents of the Parri measure insisted that pas- sage of the bill would disfran- chise a party already repre- sented in Parliament, thereby creating an undemocratic pre cedent. They also held that, under the Italian Constitution, only the courts can rule on outlaw- ing a party under a •constitu- tional pro vislon prohibiting revival of the Farcist party.
