But Nazi pickets, carrying placards urging gassing of Jews, are immune under the local interpretation of "free speech." But he becomes a fanatical liberal when the poten- tial defendant is -a member of the Nazi Party. King shocked Washington by ordering a Jew held for trial for annoying "Mr. Rockwell" by (Direct JTA Teletype Wire to The Jewish News) WASHINGTON — The activi- ties of a member of the United States Marine Corps in the "American Nazi Party" found the Corps and the Department of Justice Tuesday at odds over the facts of the case. The Marine Corps has taken the position that it could not act against the Marine because the Justice Department had ad- vised that the Nazi group' was not on the Attorney General's subversive list and there was no violation of the law. . Assistant Attorney General J. Walter Yeagley informed the JTA Tuesday that "neither I nor anyone in the Department of Justice to my knowledge has furnished the Marine Corps with an opinion concerning the affiliation of Marines with the American Nazi Party." He added that regulations for the conduct of Marines "is not within the province of the De- partment of Justice; likewise, any determination as to whether such regulations have been vio- lated is not a matter within the jurisdiction of the Department." The Marine Corps asserted its contention that the Marine's affiliation with the Nazis was legal because the party was not on the Attorney General's list. The Justice Department was reported Tuesday to be con- tinuing its inquiry into activi- ties of Rockwell and his party, but the Assistant A.t t or n e y General noted that before the Department could take action "there must be specific evidence to establish violation of a specific_ Federal statute." He pointed out that "not- withstanding the highly offen- sive nature of the activities, they usually involve the inter- pretation and application of the free speech and assembly guarantees of the First Amend- ment and the Constitution." A delegation representing the Anti - Defamation League of Bnai Brith, headed by Ben Strouse, Chairman of the Re- gional ADL Board, conferred with Secretary of the Interior Seaton Tuesday on the con- tinuing use of District of Columbia Park area under the Department's jurisdiction f o r rallies by the Rockwell group. King and the Park Police were charged by the Bnai Brith Anti - Defamation League with "misguided" interpretation of their responsibilities. The ADL stand against the licentious abuse of "free speech" principle is rejected by another commu- nal group. The District police, several months ago, actually hecto- graphed an order to arrest Nazi agitators for disorderly conduct. Hearing of this, the communal group rushed to District authori- ties and managed, at the last moment, to prevent issuance of the orders. It was feared that Nazi "free speech" might be jeopardized. The president of the body said "it would be a bad bargain to secure the arrest of a crack- pot like Rockwell at the ex- pense of transforming the dis- orderly conduct statute into a vehicle capable of being used for the suppression of free speech." But the same man remained silent when police, coddling the Nazis, arrested Jews who sought to exercise freedom of speech. Nor did the American Civil Liberties Union have anything to say about the denial of first amendment rights to Jews. The rallies are sadistic at- tempts by the Nazis to incite violence against Jews. Some of the. Nazis put on plastic noses, mock "Jewish" accents, and circulate in the crowd to pro- voke anti-Jewish excitement. The Nazi headquarters in nearby Arlington, Va., features military discipline, guard duty, racks of guns and a military training program. Stormtroop- ers punch a bag on which is painted a "Jewish" face. The Nazis joke about erecting a huge concentration camp and g a s chamber to manufacture what they say will be called "Anne Frank Soap."
