Appeals Court Sustains Ban on Mixed Seatin NEW ORLEANS, (JTA) — The Orleans Paris Court of Ap- peals unanimously sustained an injunction banning the officers and directors of Congregation Chevra Thilim from introduc- ing family seating in the syna- gogue. The injunction was issued by the late. Judge Frank J. Stich after a lengthy hearing. in 1957 Which- attracted world .- Wide' iiewiih attention. Judge Stich's ruling, Order- ing retention of a mechitza, a .physical barrier separating men from women at worship, was .based on the argument that its elimination would constitute "a :diversion of the use of the syna- gogue to a purpose other than provided in the charter and also stipulated in the act of donation by Benjamin Rosen- berg," a founder of the syna- gogue. Judge Stich accepted the ar- gument of proponents of separ- ate seating that a majority of the congregation _ could not change such arrangements be- cause such a chance would de- prive the minority of its reli- gious rights. The case had been appealed to the Louisiana S u p r e m e Court, which had refused to ac- cept jurisdiction and trans- ferred the appeal to the Paris Appeals Court. David Herman, congregation first vice-president and one of- the attorneys representing the congregation, said a request for a re-hearing would be filed soon with the appellate court. He added that if the lower court rejected the request, the con- gregation might seek a writ from the State Supreme Court.
