Surviving Spouse:
Income Tax Facts

Under certain conditions, a
surviving spouse may have the
advantage of using the tax
rates under Schedule II which
are the same as those used by
persons filing a joint return.
There are four requirements
to qualify:
(1) Your spouse must have
died in either of the two years
preceding 1958; and
(2) You must have been. en-
titled to file a joint return
with your spouse in the year
of death, It is not required
that you actually filed jointly,
but only be entitled to so file;
and
,3) You have not remarried;
and
(4) You furnish over half
the cost of maintenance of your
home which is the principal
abode for your child or step-
child for whom an exemption
is allowable to you.
When claiming the Surviv-
ing Spouse computation, you
must use the Form 1040. You
may not compute your tax as
Head of Household as long as
you are entitled to the bene-
fits of Surviving Spouse.
A Surviving Spouse may file
a joint return in the year of
death. For the next two years.
he or she may use the joint
re t u r n rates as Surviving
Spouse if the above conditions
are met.
