GENEVA, (JTA)—The inter- national maritime conference here approved a new principle of international ' law which, without mentioning the state of Israel, confirms the right of ac- cess to and from the port of Elath. The -vote by which this new principle passed in the 87-nation gathering, was 31 to 30, with the Soviet and Arab blocs lining up in oppositiOn while the Western nations supported Israel. The resolution must achieve a two-thirds majority at the conference plenary session next week to win final approval. The committee on territorial seas rejected a definition which would have made the right of innocent passage through such waterways conditional on the "interests" as `well as "security" of the coastal state on the af- fected waterway. The United State delegation objected to the inclusion of "interests" as being too vague. The committee-approved defi- nition applies the right of inno- cent passage to any ship travel- ing through the territorial seas of one country across the terri- torial waters of another state. Israel has contended that its ships, sailing from the port of Elath at the head of the Aqaba Gulf, have the right of passage to open seas through territorial waters adjacent to the Egyptian. coast at the Strait of Tiran. The approved definition holds that passage of ships is inno- cent as long as it is "not preju- dicial to the peace, good order or security of the coastal state." Elath lies at the head of the Gulf of Aqaba, which stretches more than 100 miles southward to the Strait of Tiran. Egypt fortified and closed off the strait against shipping bound into or out of the Israeli port until the Sinai operation freed the area. Hebrew, English.
