Israel Attorney on Visit Here Claims Three

. Last July, it was thought
that the much - publicized
'"Kastner Case" h a d ended.
Last weekend, through Shmuel
Tamir, an Israel attorney, sev-
eral Detroiters learned that
there not only still exists a
Kastner case, but three of
them.
Ta,mir was guest of honor at
a party given by Mr. and Mrs.
William Hordes, of Marlowe
Ave., with whom he stayed.
during his two-day visit here.
As the attorney who de-
fended Malkiel Gruenwald on
a criminal libel charge against
Kastner and won his - acquittal,
Tamir said the Israel courts
have pending:
1. A civil case brought by
Kastner for 50,000 pounds on
the libel charge;
2. An appeal brought by
the Israeli government
against Gruenwald, which
will be tried by the Israel
Supreme Court this spring;
3. A counter - suit brought
by Tamir, as Gruenwald's at-
torney,. against Kastner for
perjury, which comes up on
Feb. 5.

Tamir; an alert and person-
able gentleman, the son of Dr.
and Mrs. Reuben Katznelson,
was distressed that the case
had received such widespread
notoriety in and out of Israel.
The Kastner case, now over
two years old, involved charges
that Gruenwald libelled Dr.
Joseph Kastner, former head
of the Hungarian Jewish Res-
cue Committee, by stating in a
pamphlet that Kastner had col-
laborated with the Nazis.
Since Kastner was an em-
ployee of Kol Israel, the Israel
government's radig station, the
charge against Gruenwald was
brought by the state prosecu-
tor. Kastner was but a witness
in the sensational trial, which
precipitated the fall of the Is-
rael government, last July.
Two aspects of the trial ap-
peared especially to vex Tamir.
The first was why the case was
brought to a court trial in the
first place, instead of being
brought before a committee ap-
pointed by the government.

ing point, Tamir says, were the
comments made in this coun-
try, in Germany and in Brit-
ain, originated through an
article- by Zeev Lacqueur in
Commentary, disputing the in-
tegrity of.. Judge Benjamin Ha-
leVi, the Jerusalem magistrate
before whom the trial was
held.
Tamir said that Judge Ha-
levi had gone through 3,000'
pages of testimony and 300
documents in the Kastner case
before rendering a decision
which took him 13 hours to
read and covered over 300
pages.
That anyone has the right
to dispute his integrity, Ta-
mir asserted, is a slur that is
base enough in itself, but
such a charge is also a di-
rect allegation' s against the
entire judicial system of Is-
rael, which, because t h e
country has no constitution,
is the last word on justice.
Tamir, in discussing the
lengthy reading of the verdict,
said that Kastner left the court
at 2 p.m. to discuss with. Prime
Minister Sharett and his Cabi-
net on the progress of the
reading.
At 3 p.m., while Judge Hal-
evi was still half through with
his declamation, Sharett had
already ordered an appeal with
the unprecedented wording that
the case would be reviewed
