Kastner Case to Continue In Jerusalem Court; New Charge Is Perjury TEL AVIV (JTA)—The "Kast- ner Case," which caused the re- organization of the Israel gov- ernment barely a month before the elections, was reopened in Magistrate's Court, but was im- mediately postponed and trans- ferred to the Magistrate's Court in Jerusalem on a legal techni- cality. The second phase of this case resulted from a civil action which Malkiel Gruenwald, w h o was cleared of libel charges after a year-long trial, claimed that the principal witness against him, Dr. Israel Kastner, had commit- ted perjury during the earlier trial. The transfer to the Jerusalem court was ordered by the Tel Aviv magistrate because Gruen- wald alleges that the perjury took place in the District Court in Jerusalem. Gruenwald was prosecuted by the Attorney General who charged that Gruenwald had lied in a pamphlet accusing Dr. Kast- ner, former head of the Jewish Rescue Committee in Nazi-occu- pied Hungary, of collaboration with the Gestapo. Since Dr. Kastner was at the time of the alleged slander a government employee, the state prosecuted the case and Dr. Kast- ner's role was that of a witness. The District Court held that Mr. Gruenwald h a d substantially proved his charges against Dr. Kastner. `Hot Rod' Anti-Semites Caught by Phila.
