Bavaria Seeking to Re-Open

MUNICH (JTA)—The Commit-
tee on Petitions of the Bavarian
Parliament has unanimously ap-
proved a motion calling upon the
Bavarian government to reopen
restitution cases that have al-
ready been closed through return
to the original Jewish owner of
the house, real estate or business
involved.
The motion bears the official
endorsement of all five party
delegations in the Landtag: the
Social Democratic Party, the Free
Democratic Party, the BHE re-
fugee party, the Bavarian Party
and the Christian Social Union.

Last November, the Legal Com-
mittee of the Bavarian Parlia-
ment unanimously adopted .a res-
olution describing the mandatory
return principle of restitution
legislation as "contrary to pub-
lic policy and morals" and ask-
ing for its abrogation.

Honor Miss Hennock
On FCC Retirement

Miss Frieda B. nennock, who
is retiring as a member of the
Federal Communications Corn-
mision, will be honored at a tes-
timonial dinner on Wednesday
evening at the Shoreham Hotel
in Washington, D. C.
Among the sponsors of the din-
ner are former President Harry
S. Truman, Mrs. Eleanor Roose-
velt and Gov. W. Averell Harri-
man of New York.
Miss Hennock,
a sister of Mr.
Jack Hennock
and Mrs . A.
Gerson of De-
troit, h a s been
the subject of
laudatory e d i -
torials and arti-
cles; regretting
the fact that she Miss Hennock
was not reappointed by President
Eisenhower when her term ex-
pired.
The St. Louis Post-Dispatch
declared that she "gave the FCC
a spark of imagination and in-
dependence which has seemed
sadly lacking in that agency
regulating radio, television and
other interstate communications.
Nobody could question her devo-
tion to the public interest.
"In fact, the nation would not
now have a system of echication-
al television if it had not been
for Miss Hennock. She fought
commercial telecasting interests
and. official colleagues to get TV
channels set aside and made safe
for education."

Refuse to Give Up
Catholic Youngster

BOSTON (JTA)—With a war-
rant out for their arrest for al-
leged contempt of court, Melvin
B. Ellis, a Jewish businessman of
nearby Brookline, and his wife,
failed to surrender their four-
year-old adopted daughter whom
they had been ordered to give
up -because the child's natural
mother is a Catholic.
The attorney for the Ellises
said that the couple -had. not- come
to court because Mrs. Ellis was
ill from anxiety over the child.
The attorney said the child might
be surrendered later but said
that "we haven't decided yet just
what is to be done." He also said
that the Ellises would "fight to
the finish" to keep the child.
Mr. and Mrs. Ellis have cared
for the girl, Hildy McCoy, since
she was 10 days old. Marjorie
McCoy, the child's mother, was
unwed when the infant was taken
off her hands by the Ellises, but
she has since married.
When Mr. and Mrs. Ellis ap-
plied for adoption papers recent-
ly, Probate Judge James F. Reyn-
olds turned down their petition
on the grounds that, as Jews,
they should not adopt a child of
Roman Catholic parentage.
The child's natural mother has
said that she will turn Hildy
over to a Catholic organization
for placement in a Catholic foster
home. Ellis has said he would
give up the child to her mother
if she will bring her up, rather
than surrender her to the organi-
zation. He has also offered to
raise the child in the Catholic
faith if the court permits him
to keep her.

which ordered a new trial.
As a result of the trial, the
court at Bucharest again found
him guilty, and sentenced him to
a prison term of four years, but
ordered him released immediately
since he had already been de-
tained for almost six years.

Abir was brought to trial only
last year, along with 20 other
