German Party Hopes to Rule Unconstitutional Law Barring Jews as School Teachers BONN, (JTA) — The Social Democratic Party, supported by a number of deputies from other political groups, plans to bring suit before West Germany's Su- preme Constitutional C o u r t against Article 36 of the Rhine- land-Palatinate State Constitu- tion, which makes teaching ap- pointments in the public elemen- tary schools conditional ..ipon membership in one of the Chris- tian denominations. As reported by the Jewish Telegraphic Agency at the time, the Social Democrats failed in an effort last year to have this discriminatory provision rescind- er'. by the Rhineland-Palatinate legislature. They are now going a step fur- ther. by seeking to have Article 36 ruled unconstitutional, on the ground that it violates the guar- antees of religious equality con- tained in the West German Con- stitution. For such a suit to be considered by the Supreme Constitutional Court, it must be signed by one- third of all Bundestag deputies, which is more than the effective strength of the Social Demo- cratic delegation. In one sense, it provides answers to a number of questions which people frequently ask about the past of the Jewish people how a people 'so widely scattered, was able to maintain its unity unbroken for a milleni- um and a half; how a language, no longer in daily use, was kept alive; how a tradition, which constantly met with opposition, retained for so many centuries its freshness and vigor; how a religion, practiced by a minority in a hostile environment, was able to adjust itself to new situ- ations; how a literature became a source of life. In quite another sense, the volume also raises the question of Jewish unity now and of the methods currently used for the adjustment of Ju- daism to contemporary life. - Dr. Freenhof begins his book with a careful explanation of the term Responsa. They were learned and authoritative an- swers to questions in Jewish Law. asked by local leaders anywhere in the world and answered by a recognized teacher (rabbi) in some center of Jewish learning. The questions dealt with matters small or _large, religious or eco- nomic, private or communal; the answers derived out of the vast store of Jewish traditional learn- ing which ul'Amately went back to Mosaic Law. Source and loyalty to source remained con- stant; applications of it varied in accordance with time and need. Dr. Freehof's numerous examples of this, drawn from various eras and from the writings of differ- ent men who lived in different environments, affords an un- paralleled insight into the life of the Jews and the external vigor of Judaism. Moreover, this is done not in the ponderous fash- ion of the usual learned tome, but with remarkable simplicity in approach and lucidity in presentation. The break in Jewish religious unity, the improved means of communication, the growing misunderstanding of Judaism as a religion, the use of the method as a purely intellectual exercise —all of these have contributed to the decreases in Responsa Literature. Will it be revived in Israel? Can it be revived in the Diaspora? Dr. Freehof's discus- sion and his deep sympathy with the responsa method raise the question whether an effort ought not to be made to rehabilitate it for contemporary Judaism. however, by Dr. Thomas Dehler, chairman of the Free Democratic Party, by some members of the refugee party and by only one of the 244 deputies of the Christian Democratic Union, Prof. Franz Boehm. - When questioned about the is- sue, Rhineland-Palatinate Min- ister of Education Dr. Albert Finck, of the Christian Demo- cratic Union, declared that Jew- ish parochial schools could of course be established if Jewish parents in the state desired it. In that case, he added, Jewish teachers might be employed at such parochial schools. - SPECIALS FOR PASSOVER S Borenstein's Book and Musk Store XCL V Only MANISCHEWITZ Gives You This EXTRA Feature!
