State Law By FRANK SIMONS The case involving Meyer Liebman, Detroit butcher ac- cused of selling non-kosher meat, was concluded last week when a six-man Recorder's Court jury ruled that Liebman was not guilty of the charges brought against him by the State Agri- cultural Department. The case, which had dragged through the courts since last April, established several prece- dents and revealed several weak- nesses in the system of state supervision, and also brought counter charges from Liebman' against the Council of Orthodox Rabbis. The interesting and unprece- dented case was based on two principal theories—the first, was Liebman selling n o n - kosher meat? The second, if he was, was he entitled to use the tradi- tional -six-pointed star in his . window? When Liebman was first in- -dieted by the Council of Orth- odoxRabbis as. selling meat in violation of kashrut, the case was brought to the attention of the State Agricultural Depart- ment which demanded that cor- rections be made. On a second and a third visit, Liebman was charged again with selling non-kosher products and was ordered to have his kosher sign removed.. This, he did for a few days, according to the Council, and then reinstated not the word "kosher," but the Jewish star, which the Council claims has come to signify the same thing. When he was ordered to re- move the sign, Liebman refused, and he was brought to court, charged only with evidence taken from that fourth visit. Liebman's attorney, Larry Middleton, pointed out to the jury that the Michigan statute referring to Kashrut, although requiring a restaurant serving kosher food to indentify , itself with both the Hebrew word, "Kosher," and a star, requires a butcher similarly engaged in selling kosher meat, only to use the Hebrew word "kosher." The pace of the trial stepped up as confiscated meat was shown as evidence of kashrut violation. The evidence intro- duced were pickled tongues taken from the brine barrel of Liebman's market. While the prosecution tried to show that the tongues did not have the necessary stamp re- quired by rabbinical law, defense attorney Middleton explained that the merchandise had been approved but that the stamp had worn off during the brining process. When the jury brought in a collusion Liebman testified the Kosher Butchers' Associa- tion has a monopoly on who is to get approval from the Rab- binical group in order to open a meat mark e t, and added that the only way a new butcher may open a business is to buy out a butcher now in operation. Thirdly, the trial demonstrat- ed that if observant Jews expect to receive kosher meat when they buy, they are entitled to a better system of supervision on the part of the state and the rabbis.
