DETROIT JEWISH NEWS-5 MUNICH, (JTA) — The key witness in the state's case , against Philip Auerbach, onetime' head of the Bavarian Restitution Office who committed suicide immediately after his conviction on charges , of fraud in office, himself was convicted of per-- jury in another case by the Mu- nich Court of Appeals. The convicted perjurer, Karl Diekow, had testified that Dr. Auerbach had demanded a kick- back from a contract awarded Diekow by his office. At the time Diekow was a witness in the state's case against Dr. Auerbach his own perjury trial was pending. • The' prosedution neglected to inform the court of this. and some quarters believe that Die- kow's trial was deliberately held up in order not to prejudice the value of his testimony against Dr. Auerbach. Subsequently Diekow was con- victed, was sentenced to a year in prison, and appealed to the higher court. This time his sen- tence was reduced to eight months and he was given a sus- pended sentence, although the original conviction was upheld. A grant of $1,000,000 went to the New England Center Hos- pital for research purposes of the Jacob Ziskind Research Lab- oratory, also built with funds contributed by the philanthro- pist. One-half million dollars went to Beth Israel Hospital here to finance research fellow- ships and $100,000 went to Union Hospital in Fall River for the development of a research lab- oratory. Brandeis University received the sum of $500,000 as an en- dowment fund to underwrite the University's program of attract- ing topflight scholars for its fac- ulty, while Smith College re- ceived $500,000 to build a dormi- tory for 65 students. Weizrnann Institute received $100,000 for cancer research; Beth El Tem- ple, in Fall River, received $140,- 000 to initiate a fund drive; and $235,000 was contributed for the construction of the Lowell He- brew Community Center.
